How do you know if its an ADR hearing or a full hearing? It doesn't say on any of my papers.
Well...they have two options for appealing, ADR is said is the fastest less formal appealing way and Full Hearing which is pretty much like going to court.
Did your lawyer mention these two options to you?

Good luck

No because I chose to not have a lawyer when they asked me. It said I didn't really need to have a lawyer and we can't really afford to have one. I have been living in Istanbul for the last 6 months and just came home for my hearing.

Well I had my appeal yesterday. It was terrible. I thought I was prepared but I wasn't. It was me against some really mean nasty lawyer who was doing everything in his power to make my husband look like he only married me to get into the country. Even though I have
been living in Istanbul for 6 months (from end of August to March). Plus I made it quite clear that my husband doesn't know english and
that I have been learning Turkish and they insisted on testing his english and my Turkish. They used up both of the phone cards I provided to ask Murat questions. Everything was just so bad. The opposing side went all the way back to the sponsorship application and questioned me on how we filled it out and whether Murat even understood what he signed. Murat and I did go over it together, but he just made everything look like we were scammers. And we're really not. We've tried to do everything right.
This time Murat was able to answer everything about where I live and my family here, because he really does talk to them on a regular basis. And the photos I sent to both sides shows just how close Murat and I were, and with his family too. I don't know how they can say no, but after how mean that lawyer was I already feel so defeated :'(

I'm sorry to hear it was a rough time. Were you told when the decision would be given?

The judge said I would be given an answer by mail. I have no idea how long that will be. But if the wait I had after my husbands interview is any indication it could be 5-6 weeks.

ahhhh i'm so sorry...i was actually anxious to see how it went for u and was hoping for something more positive....is it common for them to talk on the other side of the world (if they want to talk to him, why not grant him visitor visa, not over the phone :-X)...did u have other witness, members of ur family? (didn't their input matter at all?)

don't give up stay strong!! all my good thoughts r with u and i always believe that when something happens, even if it looks bad, there's a good side to it too, which we don't see it at the moment but hope u'll see it soon

my best thoughts go with u

When I first heard that I was granted an appeal I spoke to this woman about witnesses. I asked if my mother would be a good witness to
have with me to testify on my behalf. But she didn't seem to think so unless I could say exactly how long it would take for her to talk. she also stated it would be a waste of time(which was kind of stupid because my hearing was 4 and a half hours) but I could bring her or else just get her to write out a statement sign it and that would be the same thing. I wish she could have been there though. I felt really lost. I never knew it was going to be a court case. I thought maybe it would be something less formal. I was not allowed to bring up any new things and was continually cautioned to not speak out of turn. I just feel so devastated.

Oh So sorry to hear it was so tough on you...Did you see the reasons for refusal? in your CAIPS Notes?
I was also hoping a positive answer on your case... and looking forward for the good news
I hope they resolve to say yes to your case
Did they ever clarify what option did they give you? ADR or Full Hearing?

Kind Regards, it all will work out fine.

I'm sorry to hear it didn't go well. Maybe the judge will see it differently.

Yes I finally did see my CAIP notes. They just really don't believe he married me for any reason other than to get a Visa. They think he'll come to Canada and then leave me. That I am being duped. We've been married for almost two years and I've been living there for almost 7 months. I came all the way back to Canada for this??? We've both tried very hard to get to this point. It's so unfair. Sorry to be a whiner but I just feel really emotional about this. I told the judge at the end that I really need them to say yes because if they refuse I will have to move back to Turkey again. Away from my family, my friends and everything that I worked hard for here. But we cannot live apart like before. It's too hard.

Wow is really so hard to believe.
When you say that you finally did see your CAIPS notes, you mean you saw them just now? or earlier in the process?
Is hard to understand all the questioning, keep hoping for the best...My thoughts are with you.
