He must be included in your application as your dependant.

but what if they ask for his biometrics or medical chk he is 3 years old and i cant get those stuff done as ex-wife cannot be reached out
He must undergo a medical. Your PR application will not be processed. You have to prove that you don’t have custody or your ex refuses for child to undergo the medical. If not included in your application, & you get PR, you can never sponsor your child.

the idea is that the divorce happened back home recently so no proof of custody yet and the certificate didn't state anything about it

You must include the child or you can never sponsor your child, ever. Did you get ITA or expecting to? Start talking to your ex to get the child’s medical.

I am expecting to get it next draw (crossing my fingers). the problem is now I am thinking loudly with you. if I put him as a dep. child and ex-wife didn't respond back I will be stuck as no proof for custody only a divorce cert. but if I put myself only is that considered as falsifying info?

Sorry I confused you. Custody has nothing to do with it right now. Your child MUST be included. When you get PR, the child MUST undergo the medical. IF the child doesn’t and you can prove that you were unable to get the medical done, then your child is not included in your application but then you can NEVER sponsor them. If you only include yourself then that is misrepresentation and you can NEVER sponsor your child.

so one last question, after receiving the ITA, or after receiving the PR card they ask for my child's medical to be done. is there any option after recieving the ITA to select that I will not include my child for this application? in other words, after ITA is it about docs filled up or do we answer questions (questionnaire) ?

No. You must include your child in your PR application with the child’s medical. You will not get your PR approved until child passes the medical. If you decide not to include the child it would be because you cannot get your child’s medical done. Then IRCC will decide on whether your PR is approved and you can NEVER sponsor your child if not included and child doesn’t complete the medical.

I know it is impossible to get the medical done. his mom will not let me do that, unfortunately. so that means I should not include my child otherwise my application will be stuck forever. TBH, I don't know after the new update about no upfront med exam required that may allow me to submit my application with a letter of exp. requesting not to send me a med.exam for my kid?
