How long it takes Open Work permit to be issued when applying for inland sponsor

Hi,

i gave up my PR on Aug 2011 because i did not fuilfill the 730 days minimum requirements and i admit it that when i was interviewed by Canadian Border Agency, However, i was able to obtain a 1 year multiple entry visitor visa to visit my wife and 3 kids who are in good PR status.

The situation now is that my contract is terminated in UAE, Abu Dhabi and i'm seriously thinking to go back to my family and find a job there. The processing time for outland sponsorship from UAE is 25 months which sets the record for most longest durations among all other offices. So, i'm thinking of inland processing durations (11 + 8 months) for faster processing compared to outland.

The problem is -where i want your valuable advices for- is about how soonest i can get the open work permit when we apply for inland sponsorship ?
Is it going to be issued once payment is made or is going to take the full 1st step validation duration (11months)?

2nd, given my previous history with PR, is going to complicate things or make it easier since i was honest with them ?

3rd, is there anyway i can go out of canada to visit my father in Saudi .. while keeping the inland PR processing as is ? also what would be the impact if i find a good work opportunity outside canada ?

4th, my visit visa expires 31 dec 2012, do i need to renew it while inland PR processing is undergoing ?

1. You should apply for the OWP at the same time as PR, but request that it not be processed before you are assessed for first stage approval, or AIP. If you do not, they will likely process it before and reject it. That means you have to wait the 11 months it takes for AIP to have the OWP.

2. It complicates it. PR is not an expedited visitor's visa. You had the status before, what is supposed to convince them you will abide by the regulations a second time around?

3. Inland processing means the spouse remains in Canada. A TRV is NOT a guarantee of re-entry, and if you are denied re-entry, your Inland application is deemed abandoned and you have to start over, Outland, with all that time and money lost and 25+ more months of processing.

4. Yes, you should maintain your legal status. Apply to extend your stay on the basis that you have a PR application processing, attach the necessary documentation. Usually they look favourably on such requests, provided you give them everything they need.

Do i have the option to leave and come back up until i receive their decision on my AIP and OWP (11 months duration) ?
The problem is, i cant detain my self doing nothing for 11 months .. i will keep going in and out up until they decide ? Does anybody had similar experience ?

No, you don't have that option. Inland processing means the applicant remains in Canada. If you want the option to go back and forth, you need to file an Outland application. You must be living in Canada to be sponsored via the In Canada option, that is how it works. If, for whatever reason, it is not feasible for you to do so, then you cannot use that option.

i was thinking of combination of both inland & outside canada sponsorship (given the unbelievable 25 months processing duration for Abu Dhabi office), please let me know what you think:

1. We will apply for outside canada sponsorship, which means step 1 will take 3 months only
2. i will travel to canada after 3 months to resume my application as inland and where i expect the processing duration for step 2 (person to be sponsored) will go down from 25 months in Abu Dhabi to 9 months in Canada.

What do you think .. (please take into consideration that i need to put food on table for my family and i cannot stay 11 months without work and i cannot stay 25months away from them)!

You can't do that, it doesn't work that way.

Inland and Outland are not inter-changeable, they are totally separate with their own processes, formats and fees, and cannot be combined at different stages.

1. If you go through Inland processing:

You must remain in Canada for the duration of processing. A visitor's visa does not guarantee re-entry, and your application is deemed abandoned and all fees are forfeit if you are refused re-entry. If you can't not work and cannot wait 11 months for an Open Work Permit to be processed, apply for a regular work permit first by finding a willing employer, then go to Canada and start an Inland application afterwards.

2. If you apply Outland:

You must wait out whatever time it takes to be processed. You may visit with your family if you already have a TRV, or attempt to get one, but be advised that most non-visa-exempt spouses are routinely refused TRVs.

Applicants who are refused Inland must then apply Outland, and they must pay new fees and wait just like everyone else through all stages of Outland processing. They do not jump the line because they have already been through the system, and the fees are paid all over again.

Everyone has to make sacrifices to be with their families. You'd be amazed at what you can do if you have to. Some persons wait a year or more to be with their spouses, all the while working and providing for them in another country. That's just how it is.

Charlie and others,

I've a new piece of information that might greatly help me achieve the 2 goals (working in Canada, and reviving my status as PR):

Apply Online for a work permit the soonest i get into Canada by my visitor visa (duration : 20 days)

Apply for Family sponsorship afterwards (once getting work permit) - duration for step 1 and 2 (11 and 9 months).

However, i need to check if they can exempt the condition of having employment offer if i convinced them that i need to stay close to my family ?
Also, can you please enlighten me about what would happen if i find another job after obtaining the positive HRSDC opinion ? do i have to re-apply again?

Does anybody think that regulations in Alberta or Ontario might be lenient because they are suffering from severe labor shortage that cannot be filled by immigrants instantly?

It is not as simple as just applying for a work permit as soon as you get into Canada on your visitors visa.

You will need to find an employer who is willing to hire you and they will need to get a positive LMO before you can apply for your work permit. Last time I checked LMO's were taking around 12 weeks in Alberta, but this changes all the time. To get the LMO they will need to prove that there are no Canadian citizens or residents who would be able to do the job you are applying for, plus a few other criteria. This is all detailed on the CIC website

If you want the freedom of leaving Canada, then I would suggest going outland and just waiting the 25 months. You can visit Canada during that time, work freely in your home country, or try to get a work permit in Canada - but bear in mind that this is not always as easy as it seems.

No exemptions exist. If you want a work permit then you need to find an employer and then that employer must obtain an approved LMO. Once the LMO has been approved, you can then apply for a work permit.

If I got AOR on May 5th 2017 when would I normally receive my OWP? My current OWP expires July 2017 and I am wondering whether I will have before then and if not am I allowed to remain in Canada but not work until it arrives?

You are assumed to be on implied status if you submitted your OWP alongside your PR application. Implied status means that you can continue with your current status until a decision is made on your application.

Thanks for your reply, I am here in Canada on a OWP under the IEC programme and I have heard this work permit cannot be extended. Therefore does that mean I have implied status as a visitor until my new OWP arrives.

Why are you digging up threads from 2012?? The rules are vastly different than they used.

When you got AOR doesn't matter. The OWP takes about 4 months from submission. You will have Implied Status as a visitor.
