How long for BOWP and how long if fails

Thanks to this forum, now I get to know I am eligible to do BOWP.

Did anybody have the experience in getting BOWP? I would like to know if the posted WP processing time (35 days) also apply to BOWP?

And, just in case, if one failed to get BOWP, how long can he/she still stay Canada? I mean, in that scenario, one will need some time to book flight tickets and deal with all family belongings, right?

I suspect if there is some policy like "your application is rejected, you need leave Canada within X days"? I hope something like 30 days or so which would be good if that really happens.
Well, however, I believe that is rare if one is eligible to apply.

Thanks.

If your BOWP application is denied, you will have 90 days from the date of the refusal to apply for restoration of status and change conditions to visitor. Or if you have a LMO(labor marker opinion), apply for restoration and new work permit.

Thanks, SenoritaBella. That sounds good.

Another question, maybe stupid, but just to confirm --- with BOWP I guess I can work with my current employer with the same conditions? I have gotten a new "permanent" offer from my current employer who is applying for a LMO for me but needs 3+ months.

My wife now has an OWP based on my closed WP. Once she gets BOWP, she will be able to continue to work with her employer, right?

Thanks!

As long as you apply for the BOWP before your current permit expires, you will have implied status and can continue working for your employer. Once you get the BOWP, you will just continue working as usual, under same conditions.

Just like you, your wife will have implied status too. Once she gets BOWP, she can continue working with her employer.

Just to clarify, you will be applying for a BOWP for both of you at the same time, correct?

Hi SenoritaBella,

Thanks a lot.
Yes, I am going to apply for BOWP for both me and my wife, and one "continued" visitor record for my son as well.
I will do it online and attach all the possible documents (explanation letter, AOR, OB485, and my new offer? maybe not).

Now I am filling out the forms. Just one point still puzzles me.
Should I only select "A work permit with a NEW employer"? and leave all the fields in section "Details of intended work in Canada" with "Not Applicable"? (except the 1st one).

I saw some comments that if you provide your prospective employer information some officers may be confused and then ask you the LMO.
That's scary.

Thanks.

You are applying for a permit with your current(not NEW) employer, right? I'm not very familiar with the forms, you may want to post your questions in the temporary foreign worker section for more answers.

Correct. The majority of the members here (including myself) have chosen "NEW employer", even though some of us will stay with their current employer. Apparently CIC has returned a few BOWP applications because they thought people were applying for a closed work permit, and they had to submit a LMO. Better be safe and just mention new employer. It won't matter for your current job.
