Hello,

Im a PR and ive been here in Canada for 4 months already,i want to ask if i can live in the philippines for 1 year with my canadian citizen baby??
is there a new rule about this??i want to make sure before leaving..

thank you!!

Yes, you can.

As a PR, you can stay outside Canada for up to 3 years in a 5 year period without losing your PR. Canadian citizen baby gives you no special rights.

Hi Leon,

Just a quick one....since u mentioned Canadian citizen babies gives you no rights...isn't it one of the conditions of the PR renewal requirement that if you stay out of Canada with ur spouse or child who are Canadian citizens your days are counted as if you are staying inside Canada just for the PR card renewal and not the citizenship.

No, not your child. This is a common misconception. Your days spent outside Canada accompanying a Canadian citizen spouse or as a PR child accompanying a Canadian citizen parent are counted towards the residency obligation.

A PR child has no choice but to follow their parent. With the spouses, it may be 50/50 but still they do not go into which spouse was accompanying the other. However, a Canadian citizen child can not be used to protect the PR of the parents.

Leon,

What do you mean by a "Canadian citizen child can be used to protect the PR of the parents". Do you mean if the parents are PR but one child is a Canadian citizen (by birth e.g.) makes a difference when it comes to maintaining PR status???

Sorry, I fixed it now. A Canadian citizen child can NOT be used to protect the PR of the parents. Days of a PR parent spent with a citizen child outside Canada do not count towards the RO.

You need to live in Canada 2 out of every 5 rolling years to keep your PR status just like anyone else. Having a Canadian citizen child does not give you any benefits with regards to keeping your PR status.

Since you are a PR (rather than a citizen), you must also be living in Canada to sponsor your daughters' father and you must continue living in Canada while his application is being processed.

To sponsor your daughters' father, you must either be married or common law. Common law means you have lived together for at least one full year.
