sorry what i meant to ask is
1)if the international student who overstayed was in a *genuine relationship* and they were sponsored by Canadian Citizen would overstaying as a student make the immigration agent look at that fact?

OR because the person is no longer considered a student immigration would only deal with the the sponsorship by the canadian citizen?.

There should be no issue if the relationship is genuine. However, previous overstays might lead them to put in extra effort to ensure that the relationship is genuine and not just for immigration. But if you have all the proofs and are not lying then it should be fine.

i talked with my lawyer he told to apply as Destitute Open Work Permit. is he lying to me because if there will be no solution i will leave canada asap.

was he a consultant or a lawyer?
because i lookup Destitute visa and its says something like to be eligible student encountered things beyond their control like
war
upheaval, or collapse of the banking system etc. plus they must meet other eligibility
