Hello Everyone,

I will be very thankful to you if some can help me out.

Here is our current situation:
My husband is a PR of Canada, but at present he is residing in India. We got married 6 months back and now we wish to start our living in Canada.

I came to know that if my husband has to sponsor me for PR then he has to stay in Canada itself. But we both wish to travel together to Canada.

So can anyone please let me know all the possible ways how he can sponsor me from India itself and we can travel together.

Thanks in advance,

Srilatha.

He can't... Period.

If he is a PR, he MUST reside in Canada on the day the application is received and from then on until the final decision on the application has been made. He has no option as this is a legal requirement of sponsorship for a PR.

No - he can't sponsor you while living in India.

Since he is a PR, he must be living in Canada when he submits the application to sponsor you and must continue to live in Canada while your application is being processed.

If you do not wish to be separated, then you can try applying for a visitor visa to Canada and then apply for PR once both of you have reached Canada. Unfortunately CIC often refuses visitor visa applications in these situations since they know you have plans to remain in Canada long term.

Thanks for the replies...

I would like to ask one more question.. Is there any other way that I can reach Canada with/without my husband being sponsoring me?

Also, can I apply for Open work permit visa?? I am a software professional in India.

Thanks,

Srilatha.

You don't qualify for an open work permit.

Yes - there are other ways you can reach Canada. If you can find an employer who is willing to offer you a job and can also obtain an approved Labour Market Opinion - then you can apply for a closed work permit. Or you can apply to immigrate through the Federal or Provincial programs as a skilled worker (you'll most likely need a job offer in Canada to qualify).
