hye,
i am applying under FSW, I am getting divorced, my case is still in the jurisdiction,and shall take time, how can i apply for the PR visa, is there any alternative by giving an affidavit stating my case under jurisdiction or will i have to wait for the final decree to apply.I am very much troubled, someone kindly help me out. :( :(
 
You don't have to wait to apply. You can apply now and include copies of the paperwork that shows your divorce has been filed to prove that you are no longer with your wife.

What paper work do i have to put along with my application, as I was going through the document checklist for the visa, it states to give final decree /annulment document,I am totally confused what should i do.?My case will take time as i have recently filed.just a month back, have got my credential evaluation done, waiting to apply for IELTS,once i get my doubts clear. I have a son of one and half year of age.
 
I would include a copy of the paperwork you submitted to file for divorce and then include a letter explaining that you have filed for divorce from your wife but that the divorce has not been finalized yet.

Hello mahi.2

You can get the visa but you will have to include a letter of explanation addressed to the visa officer stating your situation. You will be asked by the visa officer to provide the final decree once your application passes initial checks at CIO and is transferred to the relevant visa office.

Thank you so much for your valuable information,how about my child, what documents shall I need to get his visa as well, as it was quoted that it should be clear that the child custody is with me, is it the same procedure to be followed as for me????? ( the court appeal of divorce and the letter of explaination) or some other alternative is there my child is one year and half,I am the only one for him cant leave him.

yes you will have to include all the relevant documents to prove that you have filed the case to claim custody of your child and include this aspect in your letter of explanation also. Since a final decision is yet to come, you must tentatively include your child as dependent (including all documents asked by CIC with regards to dependents of main applicant) and include the additional fees for him in you application.

Once your application gets through. You will have to convey the final outcome of child custody to the visa officer.

I am working in India for past 10 years in IT field. I think the FSW program is closed for IT. I am trying to see if I can apply for PR through AINP or PNP program?

How do I know if I am eligible or not? I have been researching the cic but was not able to locate appropriate info

Can anyone guide me please?

Hello ranireddy,

Well you are right. At present IT related NOCs in FSW 2013 are virtually closed for applicants without an arranged employment offer from Canada. Especially if you dont have IELTS and ECA with you.

Actually most provincial nomination programs require you to have a valid job offer from an employer there... well if you can arrange that... then FSW is also not a problem.

Anyway good news for you is that Quebec recently announced their new QSW program effective 1 Aug 2013 onward and Computer engineers are among the in demand professions. Check the following link to read about it and determine you eligibility,

Remember that Quebec is a French speaking province and you will need to take French classes and need a language skill level B2 in it.
