i had 1708 hours in 2009
i was unemployed in 2010
and i have approx. 2198 hours in 2011 till the end of nov.2011
total hours will be 3906

IELTS score- 6 bands in each module

i came in canada in 25 dec. 2008 on skilled work permit (NOC 7284)
but started my job on 7th jan 2009

can some body help me that am i eligible for PR under CEC
and my three years counts from 25 dec.2008 or 7th jan 2009
as i am going to apply my CEC file on 4 dec.2011

It's three years back from the date of your application... so if you apply on Dec 4, 2011, your three years goes back to Dec 5, 2008...

But it's not just about hours, it is HOURS PER WEEK...

So first, you need to count how many weeks you were actually employed - it will have to be a minimum of 104 weeks (52 weeks = 1 year) to qualify.

Then, you have to count how many weeks you were employed full-time - 37.5 hours per week or more. Each one counts as one week. If you work more than 37.5 hours per week, it still only counts as one week. Even if you worked 80 hours in 1 week, that is just one full-time week - the "extra" hours cannot be used to count for a 2nd week.

Any time you worked less than 37.5 hours per week, it is "part-time." In that case, you add up the number of hours you worked for your part-time weeks, and divide by 37.5, that is the "full-time equivalent" number of weeks (really, it is the "part-time equivalent of full-time work").

If you worked more than one job at the same time, it's more complicated...

in 2009 i worked full time 11 months, but due to recession my employer did cut my hours for set up tools, lunch break, prepare surface for work etc




and in 2011 i started my job on 5 january 2011 but my employer had some fiancial problems and he didnt pay me from 5 january 2011 to 27 feb 2011

mean while i changed my employer and got another work permit in 16 march 2011 and now working full time and have approx 2198 hours
till the end of nov.2011

You need to complete 24 months of full-time employment AND 3900 hours to be eligible under the CEC Skilled Worker stream. Based on the information you have provided, you will not qualify by Dec 4.

In 2009 you say you worked 11 months full-time.
In 2010, 0 months
In 2011, 7 1/2 months. (Unless you can document the work for which you were unpaid, but it's still not enough).

That's a total of 18.5 months, it does not meet the requirements. If you submit your application before you have met the minimum requirements, it will be rejected.

Unfortunately, as you seem to realize, even if you keep working, you will not be able to count the 2009 experience (it will be more than 3 years ago), so unfortunately, you will need to work another 16 months to qualify - suggest looking into the PNP program...

but total months are

2009- 11 months

2010- 0 months

2011- january to nov. -11 months

but my employer 2nd employer didnt pay me from january to march

so my totals months are 22 months

and stucco plaster is outside work, no body can work when the weather become harsh

So for Jan-March 2011, you did not get paid. Will your employer write a letter stating that fact? The thing is, you have to DOCUMENT your work experience with letters from your employer, and income / tax records. If you can't document it, you will not get credit for it.

Even so, 22 months is not enough, it has to be a MINIMUM of 24 months.

Is there some reason you want to apply in early December?

Hi jes_ON, I read throughout your analysis, and I appreciated it very much. You are very helpful :)

About documenting our work hour, I did send to Buffalo the payroll records (along with employment letter, T4-2010, NOA-2010), i.e. all the pay tubs (Jan 2010 - Apr 2011), and also 1-sheet summaries of the all pay periods (showing Gross salary, Hours, Taxes, CPP, EI, Net salary, Employer remittance, etc) but the thing is I kept track the information for every 2 weeks (not weekly) as I have biweekly payrolls. Do you think it causes any confusion?

I followed your calculation, for example:

Jan 1-14, 2010: 80 hours, so I consider them as 2 full-time weeks, them I sum all the full-time weeks till April 2011.

While;

Mar 15-29, 2011: 74 hours, then I consider them as 2 part-time weeks (even though I know I worked full-time in 1st wk, but then missing some hours in 2nd wk, but I did not have record), then I add up all # of hours from other part-time weeks till April 2011, then divide all by 37.5

Lucky I got a total of 56 full-time equivalent weeks > 52 required F/T wks. That was from Jan 2010 - Apr 2011.

A while ago, I used to wonder how the VO calculated the work hours :)

Do you think there is any chance that the VO requires to assess my NOA-2011 and T4-2011? I am Apr 2011 applicant, recently had ME sent to Ottawa on Nov 16, 2011, and I am part of CPP-O.

Hi amydoan, I assume you applied as a post-grad, since you talk about 1 year of work experience.

First - I'm not a VO, so I can't guarantee how they actually DO calculate things. I know that for my application, I was fortunate enough to meet a VO who confirmed that I had calculated my hours correctly, so I'm going by that. (My contract states that I must work a minimum of 33.75 hours, which is full-time by provincial standards, but not CIC... I work 40-50 hours per week, but I'm on salary, so couldn't document it - I had to count my work experience as if it were part-time, grrr....).

Second - wow, that sounds like a lot of work - you have done the best you can, and better than most in your situation - I don't see how they can find otherwise.

Third - if your application is ready for the final decision before 2011 tax documents are available, then of course they won't ask for them. Unlikely to ask for them in any event, but this should motivate you to file your tax return for 2011 as early as possible :)

I am under post-grad stream and yes, I am prepared to file a tax return by end of Jan 2012.

I am glad to learn those calculation tips from you. I sent them those extra summary sheets of my work hours (well, I did not include them in my initial submission though, later on I sent them along with the advanced RPRF some time in Aug). Trust me, making summary sheets of 26 pay periods in 2010 and 8 pay periods in 2011 weren't too much work to me at all after I had learned that this would make my case clear to the officer.

I totally understand how you felt when you had to classify those supposed-F/T weeks as P/T. Did you demonstrate how you calculated your F/T-equivalent work experience in your submission? You were so lucky to meet with the VO btw ;D.

For me, I just did the calculation for my own reference while sending those documents as a fact so they can come up with their own calculation. Hope the answers are matching!
