Hi all
I'm new here. This forum was recommended by a friend. I have a few unclearities I need your help, guys.
My wife is an Canadian and I am from Belgium. We got married 8 months ago and submitted our PR application. It was received in October last year. Everything seems ok now but I realised I did not mention my previous short term marriage to my American wife if you could call it that. 9 years ago we got married, I returned home but soon after I received a call from here telling my the marriage wasn't recognised and I got the divorce paper. It lasted 3 months and I have never heard from her again. Because we were in the process of applying for my petition, payed a lawyer to do all that and without explanation she called everything off. she even changed her phone number and I assumed she move somewhere else because I did everything to get answers but I failed. When I met my new wife, I didn't think about it to mention the short life relationship since I did have nothing concrete to tell. Now I am wondering if it will appear unexpectedly since we apply for my PR. What can I do to fix this problem? Share your thoughts with me, guys.

It's possible your US marriage could be discovered during background checks. If it is, then you can expect your application to be refused and it's quite possible you may be banned for 5 years from Canada for misrepresentation (lying in your application).

This is a serious matter. I would withdraw your application asap and resubmit it with accurate details.

IMHO, your best bet would be with contact the visa office and withdraw your current application, change your paper and submit a new pack. Yes, it will cause a delay and cost you some more money, but better a delay now....

You MAY also be able to simply send them a letter with supporting documents (divorce certificate etc.) explaining the situation, but whether or not they accept this might be a bit of a gamble given the seriousness of your omission.

I am sure others will have opinions on this too.....

We just received our second aor so now I am really worried. How likely is it that the background check will releave my nightmare even though I have never lived in the US.
My wife will be devasting and it will kill me. I am so sorry I didn't think about the whole thing and most importantly not have mentioned it although I never received a divorce paper.

You will be committing immigration fraud by not telling them - VERY serious.

It is really simple, contact CIC and withdraw your application, deal with the problem and resubmit with full and correct information and documentation.

It's impossible for us to say how likely it is. But again, if it's discovered, you should be prepared to be banned from Canada for five years. Lying in an immigration document and concealing a past marriage is a very big deal.

Withdraw your application asap.

Can I send a specific request form with the missing information and explanation to the VO? Even if the PR is not granted but at least I come clean with it. It a heavy burden on my shoulder. Please help, how can I fix this mess? The son of the long disappeared ex wife listened to my plea and will send me a copy of whatever proof his mum has about the divorce sines no doubt she should has. She has been remarried twice after.

There will be no sympathy from cic about missing a previous marriage. It is clearly asked and they will most likely ban you from Canada for 5 years. You must withdraw your application. You can risk it by sending in an updated information but it will at minimum cause about the same delay as withdrawing without the risk of the ban.

There is an interview request, is it too late to cancel the application and start all over again?
What is my best chance, it was not intentionally but the consequesces seem magnificant. My wife is important to me I need to fix this. I can not let my mistake destroy over future.

If an interview has been requested - then you definitely need to withdraw the application as soon as possible. It will be up to CIC whether they allow you to withdraw at this point. If CIC accepts your withdrawal, you'll then need to file a brand new application.

The questions in the application package relating to previous marriages are extremely straight-forward. There is no way you're going to be able to convince CIC that failing to mention a previous marriage was a mistake. This kind of error can only be intentional. Your only option is to withdraw and hope CIC accepts it.

When is your interview? If its at least a month away I would order gcms notes, if they have concerns or are aware of your previous marriage it would most likely be mentioned there.

It doesn't matter. The risk is far to great for the sake of a delay.

Will an immigration lawyer be able to rectify my poor judgement no to declare my short existed marriage which was followed by the divorce two months after it took place? Any input will be a great value, I'm really devasted.

You may need a lawyer to sort out the divorce as we do not know all the details but as far as cic and your application there is really not much they can do for you but cost money.

Withdraw your application, do whatever you need to in order to get proper divorce papers, then re-complete the application package and include all details of your previous relationship with the divorce papers and resubmit. I don't see that you would need and immigration lawyer.
