hi there can anyone help me on my concern regarding declaration of common law

I'm about to apply for my open work permit this June and my permanent residence as well. Now my concern is I want to declare our marital status a common law with my partner who is living outside Canada{Philippines} with our 6 years old daughter.My daughter and my partner are using the same family name except me.so are they entitled to be declared on my application?If that so do i need to use the form of common law declaration with the commissioner for oath sign? Please help me coz I'm really bothered. thanks and appreciate all the response.

It doesn't have to be IN Canada. It can be anywhere in the world, but it MUST be Common-Law to Canadian standards. Therefore, the test is basically "in a marriage-like relationship, cohabiting for at least 1 continuous year". The actual definition is on the CIC web site.
