I'm about to apply for my open work permit this June and my permanent residence as well. Now my concern is I want to declare our marital status a common law with my partner who is living outside Canada{Philippines} with our 6 years old daughter.My daughter and my partner are using the same family name except me.so are they entitled to be declared on my application?If that so do i need to use the form of common law declaration with the commissioner for oath sign? Please help me coz I'm really bothered. thanks and appreciate all the response.
 
You will need to use the Common Law Declaration Signed under Oath, or By Notary Public member if you're in Canada.
I had to obtain a signed Common Law Declaration for my application for PR, with my girlfriend who is of a different name
 
Thanks a lot for the post.that form is the imm5409?.so me and my partner will gonna sign both to that form?what bothers me the most is because we have a daughter so is it fully enough that we use her birthcertificate to prove and I have the remittance slip to my partner,and some letters with the pictures during my latest vacation this 2013 January.
