hi dear
i was in my back home when i took your advice almost 2 yrs. back.
long story short i overstayed my back home on pr as my baby was too young to be left alone but i took your advice and did the right decision came to canada and now only left with 3 months towards 730 days. my son n husbands are already being sponsored.
i am well established now have a job, own a house and car.

here comes the trouble when almost i was about to apply for renewal got letter from cic to show for interview on may 2 i am so scared i don't want to lose pr status. as they asked documents in support of my sons applications for sponsor that's how they discovered that pr is expired can u please please advise what shall i do i am really tense?

i know dear what happened was i sponsored my son. so after 1 yr. they asked for supporting documents with pr photo copy so of course that' s how they knew. i am really scared now and it seems like all my efforts will be wasted hope u understand that being a mother how difficult it is to be without my son but all i did was his better future lets see

You should not apply for your PR card renewal until you have your 730 days in Canada but if they want you to attend an interview because of your sponsorship, go to the interview and see what they say.

Are they saying that this interview is because of your PR status or because of something else?

You are well established in Canada now so based on that, you have a chance at appealing when you tell them that you could not meet the residency requirements because your child was too young to leave back then. If they give you trouble about not meeting the residency requirements, get an immigration lawyer to help you with the appeal.

i was on right track i just needed your precious opinion which of course matters to me.
i didn't apply for renewal but they are calling me for interview which will decide for pr status. they also wrote that based on factors how well settled i am in Canada, and why i didn't come on time and all that they will make a decision so let's see.

i am on job since i came to Canada, i bought a house by doing two jobs in DEC.2011 all by my own, car and all that hopefully will show my commitment to get settled in Canada only i am short 90days approx. so depends upon officer how he takes it let's see. i already am taking help from a lawyer

Hi Farid-,

Your post was for me like alarm to be carefull with days which I was going to spend out of Canada. Anybody can be cought by Immigration officer to provide them prove of residency , the worst if you do not have them. Please keep us update, just wanted to ask, when u sponsored your family, was your PR card expired at that moment? What was your status? I was going to sponsor my husband, apprecite if you will mention these details. Thanks and wish you just to be strong, I believe you are strong enough, since you are building your life in Canada alone, take care.

Thanks for your comment sister you need to be strong always. here is my stories and of course i will update.
here are the details and still you have any questions don't hesitate to ask at all.

1. i became pr in 10 July 2006. i was 26 yrs. old by then.
2. went back home and if you are from India/Pakistan might understand our culture. family pressure to get married so long story short went back leaving my job and everything in 08.18.2006 and got married 11.24.2006.
3. after marriage another twist my in laws they were old and needed my help!!! as i was the oldest daughter in law they don't have any daughter. my son was born in 02.29.2008. don't ask why can't in Canada. same reason in laws they wanted him to be born there and was on my feed for two yrs.point to mention my husband is an army officer.
4. came back to Canada on 08.26.2010 as that was the only choice. to renew pr ,complete residency plus sponsor my family. hardest part left my 2and a half yr. old son. they didn't even consider giving visa..

5. came here got job sponsored my husband and son separately as i wanted my son to be here as soon as possible. another twist for Pak. immigration time line increased from being 6 months to 24 months..in 2011..pr of course was valid at that point.( i mean on the card it was but technically was less than 730 days) no question from cic at that point did all application work by myself advice to you don't go for lawyers..

6. now after waiting everyday for my son desperately. on 03.1.2012 letter from cic for my son's application to prove how you will support him this that i was happy that might be my son will be here soon with me.
7. already bought house better job car. what happened next was devastating .. they send letter on 04.13.2012 to come for interview or they will make a decision as i didn't fulfill residency requirements.

8. i didn't send the renewal as i was waiting for 08.26.2012 to complete 730 days so that's the whole story pray for me let's see i tried my level best can't do more than that you might understand how hard it is to get a house in Canada in only 1 yr. all by yourself that too by doing two jobs (i use to work 16 hrs. a day didn't had car that time) so can't do more.. waiting for my destiny praying to God to help me...that's all i can do..

advice to all don't even thing to renew pr before completing 730 days.. you can do job, buy house, car, open bank account whatever its not illegal to be in Canada with expired pr however it is like putting yourself in trouble if go for before 730 days. so be careful guys!!! i was planning the same but was not lucky enough and get caught as was in process of sponsorship. but best of luck to all brother's and sister's in same situation

Dear Leon and Farid,

Thanks alot for your story, do you think that main reason they caught you becouse of sponsorsip process? I understand that u cannot hide anything from CAD system and better to follow the law otherwise one day you will be punished. Actually I got my PR in May,2009 and will be expired in May,2014, I already stayed in Canada 146 days, still remaing 589 days. I have to go back to fullfill my residency requirements in Oct12, becouse of personal issues I thought to postpone my trip till Jan2013, I am late for 4 month, do you think that my late trip can affect in future to be cought? I realise that should not apply untill I will not reside 730 even my PR will be expired. Just scared that during the waiting period I can be cought.What should I avoid? Please let me know your opinions.

you are right i didn't hide anything from day 1 when they approved sponsorship application they new everything. and i get caught because my son's application they ask certain question so pretty sure that's what happen supporting documents i though i am close to get visa for him
for you best advice apply after 730 days if possible apply for sponsor if you have to after your renewal or at least close to 730 days. my biggest issue was my son as i wanted to be with him so i can't say i made a mistake but hope my experience will give you better idea of what course of action you should follow an di will update just pray for m sis.

Since you passed this stage, can you please advise me what should I avoid? Government Institutions? Immigration? I would like to invite my husband's parents do you think it can be risky? I will apply for visitor visa, not sponsorship. Thanks in advance. Could you contact with lawyer?

not really. with particular lawyer i just take legal advice if i get stuck else i am OK. i did whole sponsorship case myself till now did everything myself. so will give you the updates

can you please let me know the process how to get rid of a lawyer once you have signed a paper to appoint him as my representative ( I signed the paper 2 weeks before). Submission deadline for RQ is April 30. I mailed him to inquire few questions but he did not reply for the possibility of not submitting RQ because if you do not submit the required information your application stands abandoned an later on you can file a new application for renewal. Though my reason H&C is genuine but still I am waiting papers from Pakistan after correction. I being female hesitate to confront with him because I may need his help in the appeal process. He seems to be a gentle man but as most of the ppl say that lawyers are never loyal...Any guideline please!

i am so sorry i thought you are a guy..so sorry sis. you really seems like a strong woman OK!! towards your question.

1. i filled rq myself to be very honest i didn't even know that point that it's rq because as i said i sponsored my son so it came with other documents being asked for my son from Pakistan. after a month when i received call for interview then i realized oh my God.
2. see you appointed him so what's the problem. have you written to CIC that he is presenting you? even then you can write any time that he is not representing me anymore.
i actually had a bad experience . when i came here i was so desperate to get my son here that i get caught with the lawyer he took money and guess what whole sponsorship application came back. i got so angry and to be very honest i was new to the country and money was tied as well so i filled the application again all by myself it got accepted in first attempt and i wrote CIC as well that no one is representing me and guess what he was advising me that he can make fake stamps for my passport for entry and exit which i refused clearly and just kicked him out.

3. for you why you think that they you have to go to appeal. Listen be strong have faith in Allah and RQ is first step after that it's interview which i am going to have soon. in interview just go with open mind and fight for yourself which exactly i am going to do.. if God forbid officer is not convinced then its H and C appeal so don't panic
end of the day if you really feel from inside that he is not doing anything for you then take a decision an change the lawyer. but don't panic go step by step. may Allah bless you.
