Hey just a quick question about the Generic Application Form [IMM0008]

Wife is a Canada citizen by birth and I am a US citizen by birth.

We are applying for spousal sponsorship and a work permit.

We had our papers returned for some obvious errors, so now we're scouring over them to make sure we have everything right before resubmitting. Question 10 of personal details on the Generic Application Form asks for my current country of residence. I've had visitor status in Canada for several months, however we selected the US as my country of residence as I have a valid residential address their as well as a bank account. The whole 9 yards.

In hindsight this seems like It may be misleading or conflicting with other information later on in the application, as to prove the validity of our relationship we included utility bills and an occupancy agreement with my name on it. Previously It made more sense for us to use the US as my country of residence as it was more accurate. But now I've been a visitor for several months and we're not so sure.

If I where to use Canada as my country of residence, would that change the nature of my application in any way?

Also on question 12 I would still answer "NO" correct? "During the past five years have you lived in any country other than you country of citizenship or your current country of residence for more than 6 months?"
USA being my country of citizenship and Canada being my country of residence, that's how it seems to me.

Thank you in advance for any help! you guys have really been amazing at making this whole ordeal a lot less stressful.

If you are applying for a work permit, that means it's an inland application, right? If so, you should put your Canadian address as your residential address. You are required to be within Canada to apply inland and for the OWP.

If it's an Outland application you can still use the Canadian address without issue as well.

Thanks! but now that Opens up a new question.

It now wants to know the From and To dates of my current status. It took a while for our papers to be processed and returned, I've returned to the states since then, and received a new visitor status in Canada that expires in another 5 months. We where planning on leaving the other documents the same because they are dated correctly for the travel history that is listed on them. If i fill out the form using the current dates should I not update all the other forms?

Ughh sometimes I feel like the only thing making this complicated is us.

Use your Canadian address for both mailing and residential.

In case you aren't aware, US outland apps average 4-6 months or less. It will take 4-5 months to just get the OWP with an inland app. You should seriously consider resubmitting as outland instead of inland. You can remain in Canada as a visitor while the outland app processes.

Update any changes. Also check all of the forms to make sure they are still the most recent versions. I believe IMM0008 was recently updated.

I was pretty sure that we where applying outland, before it was streamlined it made more sense too me how to tell the difference. We sent the papers to P.O Box 5040 Station B in Mississauga, which I was pretty sure was the location that processed outland aps?

Edit: Will there be any issue if we dont use the updated forms?

Okay my goodness, I feel like it's a subject that's been beaten to death across the forum, but now I'm all turned around about Inbound vs Outbound applications. I understand that Outbound is much faster and allows you to travel while it's being processed and that Inbound takes up to 2 years and requires you to stay in the country.

Honestly, I have no problem with staying in Canada for 2 years and renewing a work visa as often as I need too. My family can visit me up here if they desire and I have no obligations to attend to in the US anymore. I may be wrong but people are sort of implying that you must apply inbound if you want to receive a work visa, which I absolutely need to do.

You do understand that after you become a PR, you can legally work, right?
You have to apply inland if you want to receive a work permit BEFORE you become a PR. This will take 4-5 months just to receive the work permit. Whereas applying outland takes 5-6 months for the ENTIRE process. So it will only take one more month for you to be able to legally work.

Okay, so that means we do not in fact want to submit my work visa paperwork at the same time as the sponsorship? Because that's what we where doing before.

There is no implication about it. The OWP is only available with an inland app.

Understand that as I said before, there is a very good possibility that by applying outland, you would be a PR before you would even receive the OWP with an inland app.
