Hepatitis B Case may refuse

Hi Every One,

I submitted my further medical tests on 29th January 2013 as I was detected Hepatitis B+. My physician did number of tests including liver biopsy and decided 2 years minor treatment. (Only 2 tablets daily for the period of 2 years.) The Canadian physician penal send me letter today on 18th April 2013 and they said:

Specifically, this clients health conditions might reasonably be expected to require services (Regular specialists review and follow up, antiviral drug treatment against Hepatitis B infection) the cost of which would likely exceed the average Canadian per capital health costs over 5 years. in view of the cost of the above mentioned health related services requirements , the admission of this Clint will likely create an excessive demand on Canadian health services making him inadmissible under section 38(1)(c) of the act''''

Panel physician required the further documents for there satisfaction to support my application other wise they refuse my application. Please can anyone advice if i do not want to used the Canadian medical facility and i will be responsible for my all medical expenses then what type of documents i need to send them. Will they allow that I will not avail Canadian medical but they approve my application.


Please advice I am very upset as it took more then 6 years to present and i did lot of expense for application proceeding.

What a long struggle you have had with your immigration. I am glad that your treatment regime is so straightforward and wish you luck with the rest of your processing. I suggest you read the posts by Computergeek who fought and won a medical inadmissibility decision in court. The steps he took to prove he would take responsibility for medical expenses may be helpful in your case as well. All the best.

Actually, I'm quite certain Computergeek failed to win the medical inadmissibility decision. Instead, he was sponsored by his Canadian spouse and that's how he was successful in becoming a PR. (If you are sponsored by your Canadian spouse then medical inadmissibility doesn't apply.)

Scylla. You are correct. They rushed through the sponsorship in order to avoid setting precedent with medical, but I think things were at the point where the decision would have gone in his favour in court had he not been sponsored as well. He proactively dealt with insurance coverage to prevent future medical expenses having to be carried by the state.

Hello All,

I am in the same situation as geonawaz. I wonder how does it go. Can you or anyone in the same situation share your experience.

My solution right now is
1.Book appointment with my doctor to ask him update the report (to see if is there anything he can do)
2. Find another doctor and do another test to see if he has other opinions.
3. Talk with immigration Lawyer to see if they have solution for my case and how much % i can get approve in this situation

I am so desperate now , i try to think of any possible ways i can do to get out of this situation .
Any of your input or comments will be very appreciate

"This applicant has active Hepatitis B positive serology with active liver inflammation. The natural progression of Hepatitis B infection is characterized by continuation and gradual deterioration. He is being treated by the specialist in liver diseases with an expensive medication are expensive and will likely continue for long-term in order to prevent development of co-morbidities associated with Hepatitis B infection. Additionally, he will require ongoing specialist management for care, follow-up and treatment. If his medications were stopped or did not work for him, he has a high likelihood of progression to Cirrhosis of liver, which will likely require emergency visits, repeat hospitalization, and ultimately palliative care in a hospice or at home with home care nursing support. These medications and services are publicly funded and expensive.

Based upon my review of the results of this medical examination and all the reports I have received with respect to the applicant’s health condition, I conclude that he has a health condition that might reasonably be expected to cause excessive demand on Canadian health and social services. Specifically, this health condition might reasonably be expected to require services, the costs of which would likely exceed the average Canadian per capita costs over 5 to 10 years. The applicant is therefore inadmissible under Section 38(1)(c) of the Immigration and Refugee Protection Act."

I think they will not going to accept ur application... They won't allow any person having a disease enter into Canada....
