Hi Folk,

I have a bit of a strange dilemma...

I am from China - and applied for a PR from Canada.
I am married with child - but in actuality separated - though not formally.
Although, when I applied I had to state my husbands details - although he has no desire to move to Canada with me.

I've been told by the agency through which I applied - that the whole family must be present on landing.

What would happen if me and my child were present only on landing - without husband ? Would they reject/withdraw my PR ? Send me back?

Please advise.

You have to report any marital changes to CIC otherwise there would a problem.

If you are the principal applicant, they will request medicals and the passport from your husband for him to get the PR visa but he does not have to land. The only restriction is that the principal applicant (you) must land at the same time or before the other members of your family. If you go alone with your child, that is fine. If your husband chooses to let his PR visa expire without landing, that is his business and it will not affect your PR.

If you want to be completely truthful, you can notify your visa office that you are not living with your husband for the time being although not officially separated. They may see it as a legal separation, especially if you have been living apart for a long time but unless you claimed points for your husbands education, it would not affect your application if he is removed from it.

Hi Leon,

Travelling to canada next month for 10 days only, all things booked.. also arranged a address of a friend who would send me my PR car once he gets it.

I had doubt in case if something goes wrong and PR Card is not delivered, I am planning to return permanently to canada in May 2012, Hope there wont be a problem in getting travel document in that case? As in October 11 i have completed my landing proceedures.

You will have no problem getting a TD in your first 3 years as a PR because it is not possible for you to have messed up on the residency requirements yet.
