Hi guys

My brother in law is in need of advice

He has 1200 hours of work as a butcher in Toronto and is looking to apply for his residency under the new EE method

Can anyone advise if

a) he is eligible to apply
b) which category he would apply under
c) would he need an LMIA

Thanks for all the help! :-\

a) No, 1-year full-time (or equal part time) and 1560 hours is a requirement
b) Neither
c) LMIA will give candidates extra 600 points but it's not mandatory

There are 2 different NOCs for butcher, he would first have to determine which NOC - NOC 6331 qualifies as skilled employment (Skill Level B), NOC 9462 does not (Skill Level C).

http://www5.hrsdc.gc.ca/noc/english/noc/2011/Profile.aspx?val=6&val1=6331

To be able to apply under EE, he has to meet the requirements of one of the Economic Immigration programs (Federal Skilled Worker, Canadian Experience Class, Federal Skilled Trades Program). All of them require one or two full years of full-time (or the equivalent) of skilled employment.

Canadian Experience Class (for in-Canada work experience) requires one year of full-time employment (full-time is defined as 30 hours OR MORE per week). Part-time employment can also be used, but it will take longer than one year to meet the work experience requirement.
