Help With WP Implied Status during Express Entry

Hey everyone! I don't know if I have any other option than applying for a tourist visa, so I hope you can help me with this.

I'm under a working holiday visa that will expire at the end of July. On the same day that my visa expires I get my "1-year experience" to apply for EE and should get enough points to be called on the next draw (maybe 15-30 days after applying). I don't know what should I do meanwhile related to my visa to keep working here while the whole process is analyzed. I consulted a paralegal and she said I could try a "dummy work permit extension" that will be denied in like 4 months after applying. My concern is that I'd need to get the ITA, apply for a bridging work permit & have it approved BEFORE the dummy wp extension comes back denied, otherwise I lose my status.

Thoughts? Really hope someone has been through this and have a solution. Thank you!

That "dummy work permit extension" would likely be rejected as incomplete, leaving you out of status as of your IEC expiry. That means all work done after your IEC expires would be illegal. The BOWP app would be refused because you would no longer have valid status. You would have to leave Canada.

You can apply to change your status to visitor prior to your IEC expiry. You will have to stop working.

Yeah, that's everything I know too. I wanted to know if there's any other option besides only being here as a visitor since both me and my husband have jobs already that we wanna keep.

Another person suggested me to apply for the BOWP directly instead of applying for the "dummy work permit" since there are so many cases of people applying for it without having the AOR (acknowledgment of receipt). I would be called to the next draw anyways so I would have the AOR before they analyze my BOWP, so I would just send them the AOR later on. I'm just not sure if it's worth the risk. I don't wanna lose my whole process for something so "small".

Yeah, that's everything I know too. I wanted to know if there's any other option besides only being here as a visitor since both me and my husband have jobs already that we wanna keep.

Another person suggested me to apply for the BOWP directly instead of applying for the "dummy work permit" since there are so many cases of people applying for it without having the AOR (acknowledgment of receipt). I would be called to the next draw anyways so I would have the AOR before they analyze my BOWP, so I would just send them the AOR later on. I'm just not sure if it's worth the risk. I don't wanna lose my whole process for something so "small".
Applying for a BOWP before you have even submitted your PR app and gotten AOR is still a dummy extension.

Hi @canuck_in_uk

my status is temporary worker with specific employer and my APR is in process ( I am in ip2 under SUV class ) . my permit will expire on May 1st and I have a multiple entry TRV on my passport which is valid up to 2021 ( visitor visa ). I have an international trip ahead on March and I would be back end of the March. If I apply now for work permit extension , that means +$400 out of pocket ( 2 people ) as I may receive my PR approval within next 2 months and because of that logically its better to extend our work permits at the end of March / beginning of April,

So the question that I have , if if I come back at the end of March to Canada and basically its about 35 days to my work permit expiration , will the CBSA officer give us the work permit status for the remaining time at the boarder and I can submit my wp extension after that or there may be issue cause only 35 days left and I dont have a return or outgoing ticket ? would you recommend to submit the wp extension before I go to travel or once I come back and at least 1 month before current work permit expiration date?

Apply for the extension at the end of April of your PR app hasn't been approved by then. You won't have an issue returning to Canada while your work permit is valid.

Thanks for your prompt response. my wp will be expired on May 1st. what I read in work permit extension its said apply at least one month which means at least end of March. so do you think if apply at the end of April there would not be any immigration issue by law?

IRCC recommends applying 30 days beforehand. It is not a requirement.
