Help with rushing a work permit application

Hi everyone. I need some urgent advice.

I'm a canadian citizen and I just submitted the sponsorship application for my husband on May 2010.
He has extended his visitor visa and is valid upto Sept 2011. Right now he just received a job offer from a really good company but the problem is he has to start Nov 1st. How can we get a work visa for him in a rush situation like this?

Quick response is very much appreciated.

I think this is what you need but November 1 is a totally unrealistic time line, from the wording i suspect it is aimed at those already working and needing a further TWP. Check the cic help line for more advice.


CIC has issued an Operations Bulletin respecting concurrent processing of work permits submitted to Vegreville. The section that you should take note of is:

"For inland processing, the concurrent processing option will only be allowed for foreign nationals whose work permits will be expiring within two weeks. They must provide proof of a valid job offer, as well as proof that the employer has submitted a request to Service Canada for a new LMO. Applications will be initialized and the processing fee will be processed. Applications will be held for two months (TBC for CAQ) from the date of receipt, after which a determination to either refuse or approve the work permit will be made."

So if the employer hasn't started the advertising processing or submitted the LMO, then "implied status" will not apply IMHO.

This is for an initial work permit. I've heard that we can try talking to a local cic office for this.

If he already has an LMO and TRV still valid, you could drive with him to the closest border and apply and pick up the WP from there.

Hi job_seeker!

Appreciate your response. Yes his TRV is valid until Sept 2011. But I thought only US citizens can apply and for WP at the border? By the way we live in Etobicoke. Do you know where the closest border office is?

What you're asking about is, after the sponsorship application (Stage 1) is approved, in-Canada spouses become eligible for a work permit, right? But until it is approved, ...

You should try posting this in the Family Class Sponsorship forum...

Otherwise, he will have to go through the same process as other TFWs - get the LMO, then apply for a work permit.... Will not happen by Nov 1.

If he is not from a visa-exempt country, he would have to apply for his initial WP outside of the country, may also need to go for an interview, Canadian Consulate in Buffalo being closer , and Jes_On is correct; it would not happen by Nov 1.

You don't say if he has a LMO or not?

Without service Canada confirming their acceptance that your husband is allowed to do the job, a work contract and Tourist visa will not get him the work permit.
