Help with my baby

Hi;

I received my spousal visa for Canada recently and we found out my wife is expecting our first child in December. We want to go to Canada after the baby is born, could anyone tell me can we keep our baby with us in Canada while we apply for their own visa?

If your wife is a Canadian citizen, the child will be a citizen too and she can just apply for the citizenship certificate and passport.

If she's is a PR and delivers the baby outside Canada, the child will need a visitor's visa to enter Canada. It will be difficult to satisfy the officer that your child will leave Canada at the end of their visa; so it will likely be a refusal. If you get a visitor visa for the baby, one of you needs to sponsor the child for PR and renew the baby's visitor visa regularly until the PR visa is approved.

So if your wife is a PR, you may need to consider moving to Canada before the baby is born. In some provinces, there is a 3-month wait before medical coverage begins(it covers delivery). Check online if your province requires a 3-month wait or coverage begins immediately you arrive. If you don't have coverage you may need to pay for delivery out of pocket which can be very expensive, up to $10,000 CAD (without complications).

HI Senoruta bella,, my brother & his wife moved to canada on work permit after their PNP approval & their PR file under process in CIC-SIngapore. recently they have a new baby & applied for birth certficate. Now they are confused what form they need to fill for new baby for PR visa applicantion. Do they need to fill up new form again ( generic form, family information form) & send to visa office or just birth certificate should be OK????

Was the baby born in Canada? If yes, then the baby only needs to be added to the 'additional family information' form as he/she won't need to be sponsored, nor need a visa. The baby is a Canadian Citizen if born here.

yes, baby was born in canada. should they send only updated original additional family information form??whats about birth certificate?

Hi Senorita;

Many thanks for that. My wife has a Canadian passport which she received through her Grandfather been born in Canada so where do we stand with the baby? I know the baby is not entitled to a Canadian passport through my wife as it stopped at my wife so what should we do? It definitely is not an option to have the baby in Canada.

I don't know much about the laws of citizenship by descent and whether it can be passed on.

If the baby is born before you do your 'landing' in Canada, (check the PR visa, there is an expiry date on it, and you must 'land' in Canada no later than that date), then you have to return your Confirmation of Permanent Residence (COPR) document to the visa office, inform them of the baby's birth, and add the baby to your application. CIC will tell you which forms you need to fill and whether you need to do medicals for the baby. Once the baby is added and everything is processed(assuming all goes well), your baby will also get a PR visa and a new COPR document will be issued.

May be others can comment.

Appreciate your reply. I checked the PR visa and I must land in Canada before june 2015, do I have to return the pr visa documents to the office before I go or can I do it when I land in Canada?

Ok that cool... you have some time.

If the baby is born before you become a permanent resident(i.e. before you do your landing in Canada), you must return the COPR document and inform CIC of the baby's birth.

It seems you are not understanding me.

You are currently outside Canada, right?

You will be sending the COPR document and information about the baby to the same visa office that process your PR visa. I don't know when you will receive them back - your baby will be asked to undergo medicals and if all goes well, they will re-issue the a new PR visa and COPR documents for you and the baby. After that point, you can land in Canada. You can also contact the canadian visa office that handled your application for more information. Hope this is clear.

If you received a spousal visa, that means you must have gotten a paper called the Confirmation of Permanent Residence, which is what you should present at the airport when you land. That's what she means that you should return.

The COPR is a document you should have received when they issued your PR visa. It looks like a carbon paper with your name, birth date, Client ID, country of citizenship, etc written on it, and at the bottom there is a large white box.

If you want to go to Canada anytime before the baby is born using your PR visa, you can. You will 'land' and officially become a PR. When the baby is born in December, you need to apply for a visitor visa for him or her in order to come to Canada the child. Then one of you can sponsor the child for PR.

But if you don't become a PR before the child is born, you must add inform CIC about the birth (because your status has changed). You also need to return the COPR to the same visa office that processed your application. CIC will issue a new COPR and PR visa for you and the baby.
