Help with inland application - extending visit to work on PR

Hi all,

I just found this forum and it's full of excellent info :D. Quick question: My wife (U.S. Citizen) is currently staying with me in Vancouver, Canada (I'm a Canadian Citizen) while we work on her PR forms. I'll be sponsoring her.

Being American, I know that she's allowed to stay with me for 6 months with her passport stamp as a visitor (not working and not studying) but after that she's technically over staying her welcome. We're both trying to take our time with these forms, so what documentation does she need to fill out in order to extend her stay in Canada so we can finish the inland application? Is her status important or can it lag while we work on the app?

She made mention that she needs a TRV. But that review process doesn't seem right to me as it's based on her ties to the USA and leaving Canada when it expires.

If anyone can point us in the right direction, we'd really appreciate it.

TLDR Version: which form / application does my wife need to submit in order to extend her visitor status in Canada or does that not matter?

Hi :)

I just want to share, that my husband and I went through exactly the same. He sponsored me....Im from Sweden though. But just as your wife I had a 6 month visa through my passport. And we wanted to extend it too....to work on our application.

But back then....we did not know about this forum.....so we did the best we could....it is complicated and scary to go though this, isn't it? :)

We filled in the application to extend our my visiting visa.....and we wrote and described our situation as it was. And sent in all the proof we had....marriage cert......our story......letters from family.....my doc from Sweden....in the end it became like a PR application....but maybe a little lighter. We have no clue if this was smart....or if there were better ways to do it....since we didn't have anyone to ask. So we did the best we could. And it worked.....and my visa got extended....and we got more time to work on our PR app. So I don't know if there maybe is better ways to go about it.....Im just sharing our way. :)

When I wanted to extend my stay as a visitor (at that time I didn't know if my new work permit would be approved in time) I just send a bank statement as a proof of funds and named my boyfriend and a friend as people I will visit during my stay). I didn't mention my work permit application in process and the PR we would apply for one month later. I received the visitor visa a few weeks later without any further questions.

Thanks for the detailed responses! And it's great to be a part of this forum. My wife and I are still nervous / stressed about all this as we just want to be together.

Can anyone confirm what the right form is?

Also thoughts on whether or not we should attach something that specifies my wife's I tent to apply for PR asap?

And read through it all and send everything they ask for in this page and fill our the information they ask for....The checklist is good to have....that becomes a guide and help.....That's what my husband and I did. Maybe there is an easier way...I don't know. But these links is what my husband and I followed.

I know and understand just what you feel. We have the same worry. All we want is to be able to stay together.....and live in peace.....so I know its a scary ride. You are lucky you guys found this forum....this early on. I so wish we had too.....and I was just as happy as you when we finally found it :D

Hi Make sure you send an open work permit application together with the sponsorship forms and make sure Vegreville receives it before her visitor status expires and she will have implied status (legal status) and she wont have to renew/extend her visit visa. Take note that it is not advised for her to leave the country while the application is in progress. If she needs to leave country just do an outland (US office) you can still extend her visit visa in Canada...Good luck!

So it seems the consensus is either get the PR in before her visitor status expires or work right now to get her visitor status extended. Can anyone tell me if it's a legal requirement for the inland application to have status before they receive it?

Someone was telling me it doesn't matter because once they acknowledge receipt of the PR inland app, my wife then gains implied status because she has to stay here throughout it. This person said if you do the outland app then status must be maintained if she's in Canada with me.

its not a requirement, you can still submit an inland sponsorship if she is out of status.. but she wont have legal status until you receive approval in principle where she can get open work permit or study permit...It is best to send an open work permit together with the application before her visitor visa expires so she has legal status all throughout the process. She won't have to extend her visit visa as she will be on implied status.
