Hi guys, Im sure this has been asked several times in this forum but I cant seem to find an answer. While filling out my express entry form, the question is "Do I have a job offer in Canada?" I already have a job i Canada currently and ive been working for almost a year in a new role (all my experience adds up to 1 year plus) my question is do I answer yes or no?

What kind of work permit do you have?

Then answer "no" to such question.
If I had a close work permit based on PNP (international student stream) would the answer still be No?
My understanding is that only in case of LMIA is the answer yes.

Having a job in Canada is not a 'valid job offer.' Neither is a work permit. IRCC spells out the specific criteria for a valid job offer it on its website.

So after reading this, the answer is only yes if your job is LMIA based. I said no here, got an ITA and submitted my PR application, the lawer which my company hired for PNP went over my EE profile and listed this a discrepancy. I am slowly losing faith in lawyers.

This is incorrect. An applicant with a LMIA exempt work permit which is employer specific can have a valid job offer as long as:
  • are currently working for an employer specified on the work permit
  • have one year of full-time work experience (or an equal amount of part-time work) for that employer
  • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

Confused... you got an ITA without the job offer... what's the problem? The only reason to bother with a "valid job offer" is if you need more points to get the ITA...

I hope it doesn't count as misrepresentation as I honestly thought my job was not qualifying as it wasn't based on LMIA, but it is on a closed work permit which was based on PNP nomination.

Hi

So my understanding is that I work in a bank I went through the basic hiring process. I have a PGWP. So its not based on LMIA and neither Job offer right?

You would answer "no" to the job offer question.

Date MD Sabab Alam first became qualified to practice in this occupation

If the "primary occupation" is:
  • a qualified trade (four-digit code begins with 632, 633, 72, 73, 82, 92), this is the date they became qualified to practice on their own in Canada. (For example, when they moved from apprentice to being a licensed tradesperson.)
  • any other job, this is the date they first obtained the minimum education or training stated in the NOC description. (Note: if the NOC only states high school, this is the date they graduated.
What about this? Should I mention the date I started? It doesn't ask which day though, only Month and year.

Also this

Which of these categories does MD Sabab Alam's job fall under? (required)

1. No work permit req
2. Work permit Required but not LMIA
3. Work permit and LMIA

I chose option 2. That should be correct right?
