Help with conjugal partner sponsorship

Hi,

I'm new here. I need all the help I can get. I'm planning to sponsor my girlfriend under conjugal partner. We've been together for 4 years and 1month. I've became a PR here 2 years ago. I have all the papers ready. I have a lot of proof that our relationship is genuine. I have 4 notarized support letters from family and friends that our relationship is true. My mom wrote a letter about our relationship and that she is willing to let us live with her in Canada until we can settle down on our own. I proposed to her the last time I went home and she said YES. I will also send the pictures on my proposal. I went home to the Philippines to visit her a total of 4 times for the past two years. I also have a lot of proof of financial support. We can't be together because same sex is not allowed in the Philippines and our religion wont accept same sex marriage. Her family does not know about us since her brother is a priest and her family might disowned her when they know about our relationship. She didn't try to apply for temporary resident visa because she doesn't have proof of funds. Do you think that we have a chance if we send our papers now? Thank you so much

Have her apply for a TRV first before applying for sponsorship. If approved, then get married in Canada or live continuously for 12 months to be considered as common law. Or consider getting married in another country that recognizes same sex marriage. Slim chances of getting approved now if you haven't tried any other means of being together.

Your girlfriend should try for the tourist visa first. Since you haven't tried that yet, you can't say there's an immigration barrier that is keeping you two from getting married. You should not try to sponsor her until she tries getting the tourist visa. In the eyes of CIC, they would see that she didn't even try to get the visa, even if it gets refused for not having funds. It is the right thing to do, and your next step. I didn't get a tourist visa to see my then fiancee in Canada, because of funds, and it's a good thing for the sponsorship process as they see that one has really tried and couldn't get it.
It shouldn't take long, it's just a few weeks I believe.

I will let her apply for the TRV . Wont the CIC asked me why i didnt just went home to the philippines and spend 12 months with her so we can be considered as common law? If my excuse is that we can't be together because her family will not approved and she will be disowned and that i can't find a job there that can sustain our needs. Will that be enough? Thank you so much

No, that is out of question, they won't ask you why you can't live with her in Philippines. However you can explain that, one of the forms asks you why you can't live together at the moment, doesn't ask which country. Your explanation would be more than enough.
Somewhere in the guide it says that you can't sponsor your fiaance, rather you should marry her and apply once you're married, but you have to try to get married and once you see that you actually can't because she can't travel to Canada, where it's legal, then you can sponsor her as a conjugal partner.
These are all process that take a lot of time, several months. I would advise you to take it step by step so you don't get overwhelmed by the huge amount of things you'll learn and the questions that will come to your head. For your explanation, I'm not sure, you could lose permanent residency in Canada if you decide to move out of the country for such a long time. However, they wouldn't expect you to do that at all, so don't worry about it

If TRV doesn't work, Brazil is a country that does not require a visa from Philippine passport holders and where same sex marriage is available.
Yes, but think about how complicated it would be to celebrate the wedding in a foreign country where neither of them have been in before. They would have to get an official translator to translate all the documents needed and to be present during the ceremony as well. Unless they plan to have a ceremony where just the two brides are there, it won't be cheap at all and would be really complicated logistically speaking as well. I don't think this is a good option, in my opinion. It's good to know all the options though.

Im feeling so depressed right now. I just came home from our vacation with all my hopes up that i can finally send our papers. Then i saw that we needed to try to get TRV first. I checked the requirements and it will be very hard for her to get all of those. She is working as a nurse for the department of health in the philippines but it is only on contract. They won't take her as a permanent worker. Then we spent most of our savings for our trip so she doesnt have proof of funds right now. I also saw that she needs to have a plane ticket to be sent together with the TRV application. I just really want to be with her that im considering moving back home if none of the applications gets approved. Can i send an invitation letter that i will be the one paying for all her needs here in canada if the TRV gets approved? I have a full time job that pays my salary every month. I dont really have a lot of savings but I can show them that there wil be money coming to my account every week to sustain all our needs. Will that be enough? Thank you so much for all your help. I appreciate it.

I actually searched that. I was thinking of going to brazil or columbia to get married since we dont need visa but it will be very difficult as we dont know anyone there and will cost a fortune.

You definitely cannot apply under conjugal without first applying for a TRV. Don't buy a plane ticket - include the flight itinerary you plan to purchase. Yes - you can sent an invitation letter.

There's always New Zealand to get married. Probably easier to get a visa to travel there to get married for a Philippine passport holder, easier to translate document and arrange and the sponsor her as your spouse.

If/when the TRV is denied, I think you have a very good chance for a conjugal application based on your story.
