Hi, I will agree on this. In my personal case, I was 8 months out of status when hubby and I applied. I just got DM last friday The difference from my case to yours is that I have been in Canada for 5 years, I met my hubby 4 months after my arrival, we date and few months after we move-in together. we got married a year and a half in the relationship WHILE I was still on status. When I applied, we were almost 2 years married and 8 without status. That might help. As Kessio said, they get suspicious when people LOSE status and MARRY someone after.keesio said:Normally it would be suspicious if someone got married right after their visa expired. It would look like a "marriage of convenience". But because you two have been together for 4 years and have lots of proof, I think it will be fine. But keep in mind that CIC will be looking at your relationship closely so provide some really strong proof.
Also, I came here as a student...I dont know if its any diferrent from the way your hubby came. I only know that before sending the app, my hubby call CIC a lot of times to confirm that we were able to apply inland. Which we did.
I think they are more rough with people that has a Denied Refugee Claim. Seems that Refugee claimers are the first ones to be judged.
In all my process I havent once encounter a problem. Which is actually a relief.
Anyway, is up to you to decide what to do, if you think you have enough proof from before the wedding and before his visa running out.. then go ahead.. ill say.
This is only my point of view been out of status myself.
