HELP!!! status; imm form 5406 and 5669

Subject: Permanent residence in Canada


Enquiry: Hi, I have an approval letter from MPNP for me and my son to immigrate to Manitoba. However, I just have two questions that I hope you can help me with regarding my application for a visa. You see since, my wife and I are really separated for years now though without legal papers (divorce, annulment or legal separation papers) to prove as such but only a notarized statutory declaration,

(1) should I put my status in the application form for a visa as legally separated as the description of such in the guide is married but no longer living with my spouse which fits our status? Or should it still be married?...

(2) should I still have her (former spouse) fill up and sign the form imm 5406 and 5669 even if our current status is separated for 12 years now (her living in USA and me in the Philippines and now in Singapore) with no intention of reconciliation? I hope for your kind help to enlighten me on this.

Hi, this is just my opinion and im not expert on this matter..you did mention that you are separated without legal papers so it means that you are still considered as married, your marriage is still valid, in the number 2 question i think yes..you still need her to fill up and sign all the document, explain to her the benefits that your son may have with canadian migration,she should also cooperate during application process..i may suggest that you ask help with an immigration lawyer. good luck dre pagsubok lang yan.
