Hi all,

I am currently waiting for my PR (CEC) application to be processed at NY office but my post-grad work permit expires in mid-sept this year. I've asked my employer to file an LMO for me and they've kindly agreed to do so. However, we're trying not to use a lawyer and are planning to fill out info by ourself and need help in answering some questions on LMO application.

I was hired in jan 2010 by this company while I was on a post-grad work permit and they hired me because I did a co-op work term back in 2006.

1) Job Offer Information section - "Is the job temporary with intent to permanent?" - We've answered yes, because of http://www.hrsdc.gc.ca/eng/workplaceskills/foreign_workers/intstugrad.shtml

2) Is there a labour dispute in progress ? - I don't know if this relates to the employer in which case I know they're not involved in any labout dispute, but what does this question really mean.

3) "Have you attempted to recruit canadian citizens/PRs for this job"? - we've answered "No" and have given the reason that the worker was hired because he has previous work experience here as a co-op student and was hired while he was on a post-grad work permit. Anything else that we could mention or should this suffice? Moreover, according to http://www.hrsdc.gc.ca/eng/workplaceskills/foreign_workers/intstugrad.shtml , for a candidate who has completed Post-grad work permit term in a skilled occupation (my NOC code is 2174 - skill type A - Software developer), the employer does not need to demo any recruitment efforts.
Please suggest if out answer is correct for this question.

4) Potential Benefits to Canadian Labout market for offering this job to foreign worker..? I am lost in this question and have no idea how to answer it. ??? - please suggest.

5) Rationale of the job offer making to the foreign worker.... our answer (please correct if needed)
- previous work experience with this company
- knows well the products, environment, and work-style.
- Currently working on a product to be released soon followed by help in its support issues.
- Well integrated with the team, a team player, reliable, and efficient... gets things done in a timely manner.

6) Do you plan on training Canadians/PRs for this job ? - again no idea what would the correct answer be. I am assuming "No" because if there say "yes" then hiring a foreign worker will take this training opportunity away for the canadians?? Please suggest what should I mention.

Really really appreciate all the help I can get, in particular with questions 4 and 6. I am planning to send this application off latest by next week.

my boss applied for LMO last month. and in 4 week, i got positive LMO.

1, yes
2, if your company have a problem such as labour shortage...something like that.
3, if you have been working and filled the position and company doesnt need worker, say NO.
4, the question is what is the benefit for hiring foreign work? you can say fill up labour shortage, bringing new idea....etc.
5, good
6, depends, ur company need more workers? if you fill the position and company doesnt need hire, u say NO.
if ur boss can add a cover letter(what kind of company, what we do, why company hire you....ect), that wil be great. put more detail about your work contract what you are doing, salary, work hours, vacation benefit ..etc.

Hi there,

I think I am in the same boat as you, mah87. I have been working at my company for almost 3 years on my Post Graduation Work Permit and now that my CEC PR application is processing and my current WP expires in October, my employer is filling out an LMO so that I can apply for a new work permit.

I have a couple of additional questions about the LMO application:

1) Expected start date of employment - I've worked here for almost 3 years ...do i put that as my start date? What do I put for expected duration of employment (this is a permanent job)?

2) Who should sign the application from my workplace under the "signature of employer" line? My Payroll co-coordinator who is the person filling out my application or my direct manager or someone else int he company? I assumed it would be the person who is listed as the company contact on the first page?

I'm hoping to submit this application later this week if someone can help me out with the questions above or give me any advice, that would be great!

the NOC is not required - HRSDC will assign an NOC based on the job duties. But it doesn't hurt to put the information in (if you're sure you have the right NOC). There's no space for it, so you can put it next to the job title like - "Job Title (NOC 1234)." Likely HRSDC will ignore it but you've covered your bases...

the day after your current work permit expires.

Anyone in the company with signing authority can sign it, but it should be the same person whom HRSDC will contact to verify the details... Direct manager is probably the best, but make sure the contact info is for that person...

hello ever body is it necessery to fill the first part of the LMO low skilled occupations,
i mean the part with THIRD PARTY or something.

Another thing iam workin as a demolition foreman, do you guys thing i might get a positiv LMO
shall i give it a try? its demolition of residentals ok? i mean as foreman i need some experience
theroreticaly a canadain could do the job but theres nobody who wants to that we have luck
of employees in our company.
