Hi,

I am a PNP nominee of Saskatchewan (SK). After getting PR I spent a month in the province (of course landed in SK) and went back to native country as at that time economy was in shabby condition in North America. I moved back to SK again after of couple of years and tried very hard to settle in the province for four months. I had part-time job in SK (after 2 months) not even enough for my survival, let alone to sponsor my dependent child. Somehow, survived on the money I had brought with me.

Ultimately, after lot of struggle I got a job in Calgary and moved to AB. I have been here for 6 months. I have applied for the sponsorship of my dependent child now.

Could there be any problem because I moved to AB even though I was PNP of SK and did not spend enough time there? I am worried plese help.

bluewater,
It doesn't matter where you landed or applied for immigration in the first place.

I immigrated with my family like 10 years ago for Quebec Investors program, and I landed in Vancouver and have been living there since. I haven't even been to Quebec for what it's worth.

This is from what I know, it could have changed now but I doubt it.

You have the constitutional right to live and work anywhere in Canada as in CANADIAN CHARTER OF RIGHTS AND FREEDOMS

Mobility Rights

Mobility of citizens

6. (1) Every citizen of Canada has the right to enter, remain in and leave Canada.
Rights to move and gain livelihood

(2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right
(a) to move to and take up residence in any province; and
(b) to pursue the gaining of a livelihood in any province.

Limitation

(3) The rights specified in subsection (2) are subject to
(a) any laws or practices of general application in force in a province other than those that discriminate among persons primarily on the basis of province of present or previous residence; and
(b) any laws providing for reasonable residency requirements as a qualification for the receipt of publicly provided social services.
Affirmative action programs

(4) Subsections (2) and (3) do not preclude any law, program or activity that has as its object the amelioration in a province of conditions of individuals in that province who are socially or economically disadvantaged if the rate of employment in that province is below the rate of employment in Canada
.

You should have a moral responsibility to the province nominating (sponsoring) you to live and work in that province. Having said that, you've tried all you can to stay in the province but life is not easy on you so you can just stay and live wherever you want. SK or any province will not stop you from doing that. They will not waste money on suing you in court. It's a waste of money and they know they will not win in court.
