I received a message from Mexico City immigration (my AOR) that requests additional police checks which is normal. They also requested proof of common law relationship though...

I double checked and we sent exactly 256 pages of common law proof. I asked them if they are requesting EXTRA/ADDITIONAL information as we had already submitted proof.

They replied with a formed response:

Dear applicant,

Please be advised that our office is requesting you to submit proof of your cohabitation for one complete year. You must submit documents showing the same address for you and your sponsor for one complete year (bank account statements, utility bills, lease agreements with both names) Failure to comply with our request may result on the refusal of your application.

What do we do???? I don't want to send the entire 256 pages if they are only requesting additional information but they won't respond specifically to my questions even after submitting a case specific enquiry.

Is there any way that I can contact someone else directly for them to double check my file?

Thanks

Sorry to hear this, it must be very frustrating.

Is it possible the the proof you provided didn't get through to them? Unfortunate, but happens.

How about if you add your additional proof to the ones you've already provided and send all again? From what they have written it seems they are not convinced you guys have been cohabiting.

I would send exactly what they asked for and no more. (Maybe they don't wanna sort through 256 pages of whatever.) One year of bank statements (12) and one year of two utility's bills (24) plus your lease agreement is only 37 pages . . . or so. That should fit in an envelope, as opposed to a box!

I'm assuming a lot of those 256 pages were things that help prove your relationship is genuine. For example, emails, love notes, phone bills, letters from other people about your relationship are helpful to prove the relationship is genuine. But a relationship could be genuine, and yet if you two have not lived together for a year, it still would not be enough for a common-law based PR visa.

It sounds like the visa officer has doubts that you two lived together for one year. So send (or resend, if some of this was already part of the 256 pages) objective proof of your cohabitation for one year: ideally, a lease with both your names on it, utility bills for a year with both your names on them, mail addressed to both of you at the same address spanning a year, bank account or credit card statements with both names sent to the same address for a year. If you don't have some of these things, try to explain why in a letter to the visa officer. What types of objective evidence you lived together for one year did you send already?

Agree with canadianwoman, proof of relationship is NOT the same as proof of cohabitation, so they're clear on what they're requesting, they are even giving you clues as to what constitutes such a proof: bank account statements showing same address for both, leases under both of your names, etc.

Hi all, thanks for replying.

I'm still a bit confused as I think they misplaced our entire proof of relationship section. In the AOR they said to include: joint bank accounts, joint insurance, lease
agreements, pictures, proof of communication, travel history, etc.

When we sent our application, we sent:
300 photos
joint bank account statements
Property papers to show my spouse owns our home and we don't have rent.
Lease agreements for vacation rentals
boarding passes from flights
My residency card for Mexico
a letter from his parents
a letter from my mom and also my sister
A beneficiary document for his medical insurance
another beneficiary document with his name on it, for mine.
utility bills (we don't have both of our names on the account but i do have one in my name, he has one in his.)
phone records for 3 different phone services
facebook history
Mail addressed to the both of us from friends/family.

The list could go on.

basically we have covered absolutely everything we possibly could.

I'm hoping they either made a mistake and realize it... (I don't know how i can ask someone to specifically pull up my file though and confirm what they have) OR they have actually misplaced it.
I hope they aren't requesting additional information cuz i'm afraid i have none left to give.

My MP helped us with our visitors visa once last year... Do you think I could ask the MP to check in and have someone review it or do you think that will just make them angry? I don't wanna delay the process any longer but man i don't want to put another 300 pages together.

I Think what others are saying is...do you have a full 12 months of evidence for all the above sugessted items? Also...did you make a photocopy of your whole package before you sent it off? Including the 300 pages of proof? If so...photocopy them again..maybe tabing the specific things they are asking for with 12 months proof. Maybe even add more copies since you send your app. Good luck! Its a lot of work...but it will be worth it when you have your PR status!

These things need to be covering a period of at least one year. For example, do you have 12 months of the water bill in your name, and the same 12 months of the electric bill in his name, both going to the same address?

Did the letters state that the writer knows that you have been living together for one year? They should also satate that they believe your relationship is genuine, but the one year has to be mentioned too.

They may have lost all your relationship proof, but it sounds more like they don't believe from the evidence you sent in that you have cohabited for a year. I would send in the one-year proof, and assume they have the other proof. Get your MP to help if he or she can.
