Help reject refugee /interview to get AIP

thx for your reply , the lawyer did he r appeal but no sign yet,im kind of confused the fact i am the only one to received that letter saying i met the eligibility requirement to sponsor my wife and the same letter said my wife permanent resident application will be process separately
and they said my wife will hear from us(CIC) shortly, we didnt apply work permit because she already have a 5 yrs work permit from her refugee , the fact i received this letter mean AIP only for me or ? is that letter mean the officer he or she is satisfy that our relationship is genuine which mean no interview ? i really somebody to shed some light on this issue im really confused and stressed thx for any reply

well let me try to explain, when you sent your application in it has to go through 2 steps of processing, the first step cic have to find if you are eligible to sponsor your wife, if you meet all the obligation, umm amount of money you make, tax,criminal background, then when all of that is good they send you an email saying the first part of the process is done and you are eligible to sponsor your wife, which is the letter or email you just received so that is done and decision is made for you to sponsor your wife. the next step is they will transfer the APPLICANT part of the application with your wife info and send it to the nearest visa office were she lives whether is Canada or outside of Canada. this now will determine if the relationship is genuine and if she is eligible for PPR. since she is still in canada it will be sent to the office close to were she leaves in canada, then she will get a letter saying that her file will be transferred to the visa office, that is the tand step which take maybe 6 months or less, depends. in the meantime you and your wife will get a UFI number were yourll can go on E-CAS to check the status of your application.

The process you are describing applies to an outland application. For inland application, the process is slightly different. In the first stage, they assess the eligibility of the sponsor, do a preliminary screening on the applicant ( I don't remember what exactly they screen for), and assess the genuineness of the relationship. If they pass all these, they get AIP and then they get sent to 2nd stage which is when they do a more extended check on the applicant.

I agree with millslu that the 5 year work permit means nothing if you don't get AIP; she can still get deported. However, if you do get AIP, she doesn't need to apply for another work permit as the one she already has will work just fine. I'm still looking into why we just got 1 letter instead of 2 but I got an answer from someone who's file got transferred for interview and she said that she never got a letter that said her sponsorship was approved. So it's looking good for us, but I'm not sure. I will let you know when I find out more. When did you receive the letter?

wow i guess alot has changed in a few years my bad. i did an inland in 2008 but didnt go through all that change in a few years wow.

Haha yeah I guess it has. There's even a new law now that the applicant has to live with the sponsor for a certain number of years after PR or their PR gets revoked. Or something to that effect. It didn't come into effect till after we sent in our application, so I didn't pay too much attention. I think it's really good that they're doing that because it protects against fake marriages and it's good for those of us who are genuine so hopefully, CPC/CIC would be more lenient and give more people AIP.

yes i really do think its a good idea and it would move things a little faster, just last week there was a victim from brampton ontario, i was very saddened for her, it was heart wrenching.

as far as I know they will not ask for police clearance from your home country again (if the application is inland), but they might ask you to redo the medicals since it has been well over a year! some officer do extend the existing medicals by a year but your medical has been well over a year already so they probably will tell you to redo them.

Hi, yeye2009

let me make it simple and clear for you. this means you have received AIP (approval in principle) i'm assuming you applied inland. which means you are approved for the first stage and the application is in the second stage now and you will not be interview for your relationship because you have been approved.

Second stage is mainly for the sponsored person (your wife) there will be medical and security checks and when this process is done and assuming your wife passes they will send you a letter saying "we are pleased to advice you that your application process has been completed and your local office will contact you" which means at this point the next letter that will come from your local office will be your wife's Landing date!
the second stage is done generally much quicker now compare to last year or two so you are in a good position as long as everything is complete.
