Hi All

I have a query on behalf of my sister.
She plans to apply under FSW category but there is a lot happening at her end which is really confusing.

Could the seniors or someone who has already gone through this pls help.
1) She will be travelling to canada on work permit for arnd 6 months.Is it better to apply for immigration from india itself or would it be better once she reaches there and applies?

2) Since she is married and her husband would be going for higher studies to the US,
she should apply for her husband also along? Her husband might not be able to accompany her if everything goes fine with her app and she travels to canada on PR?
What do ppl generally do in such a situation? will her husband be able to travel from the US?

Might have a couple of queries more.
Could anyone pls answer these first?

i dont think it makes a difference unless she plans to stay for longer than 6months. Can anyone else confirm that?

2) The spouse can either land with or after the main applicant. Once the person lands, the person needs to stay in Canada for 2 years out of every 5 years. if they don't do it, then they loose it. He can land from anywhere in the world but he would get a time period to land before the medical expires. If he thinks that he will not be able to fulfill the 2 year requirement, then best not to apply for him and he can apply later. i am sure he can get a visitor's visa and go visit her until he is ready to apply. What do other's think?

1) If she's only in Canada for 6 months, she has to apply from India since you have to have a one year visa to request processing in Buffalo.

2) She should apply for him too. He can also land as a PR and will only have to meet the residency oblications of staying in Canada for total 24 months out of the first 5 years to keep his PR. He can do this by visiting her during his studies and moving to Canada after his studies are done. If he thinks he will be tight on making the residency requirements, he can land as late as possible to buy some time before the residency clock starts ticking.

file processing in buffalo is comparatively faster if I am not wrong? what are the other advantages that a person has in applying from canda itself.

Under the old rules, Buffalo was 19 months and India 6 years or something like that. Under the new rules, they should both be fast but not enough experience to say how long exactly. CIC aims at 6-12 months from any country. She can still not apply through Buffalo unless she has at least a 1 year visa.

thanks Leon for the reply.

As soon as u get a WP you know how long it is valid for. So if it valid for 1 year and u start working in canada on this WP, can u apply as soon as you lnad there or is it like you have to wait for sometime like completion of 6 months before you apply for the permit.

Secondly, any idea whatr happens in case u apply from india, travel to canda on WP and they ask for ur docs, medicals after you have landed there, is there any prob getting everything done from there?
