Hi there. I got married with my Canadian lifelong partner while visiting Canada last year and applied for Permanent Residence visa. But since it was so sudden, I had to ask for the birth certificates and criminal records etc from my country of origin. Since that was taking long to arrive by mail, we decided I should apply for an extension of my temporary visa so I wouldn't worry about my tourist visa expire before receiving the documents to submit my application for Sponsored by Spouse Permanent Resident visa (I know about implied status, but at that time I hadn't even had the birth certificate to initiate my application, so it was my last resource or my tourist visa would expire the following weeks and I would be in trouble).

So I did that, I applied online for a visa extension and payed the fees. A week after my birth certificate finally arrived and I initiated the application for Sponsored PR. So tecnically I have 2 visa applications, one for extending the temporary resident and another for spousal sponsorship.

My current issue is: I have two processes going on apparently, one for Visa Extension and another for Spouse Sponsored PR. Although I have now passed my tourist visa date, I am, according to what I read, in Implied status while decisions are being made, but what do I do regarding having the two applications being processed at the same time??? The Visa Extension is taking so long that only now I have received a notice to do a medical examination regarding that application...Should I do it still? Is there any way to merge the processes? I mean, the logical thing to me would be that the Visa Extension, since was submitted first and hasn't been decided, would be overridden by the Sponsored PR one...I am worried of messing up, since I spent so much time and money on applications and filling paperwork.

Any advice would be great! Thank you

There is no problem with having the two at the same time. An application for PR does not give you implied status, so you did the right thing by extending your stay as a visitor.

Are you sure? I am almost certain I read (I can't find the link at the moment) on the CIC site that as an Inside-Canada Sponsored by Spouse Applicant I would have Implied Status until the process was resolved (I also applied for a temporary Work Permit, if that matters.)

Also, what should I do in principle then? Do the medical exams now for the visa extension and then do them again for the Permanent Resident application? Or should I cancel the Visa Extension application altogether?
Thank you.

Don't cancel the visa extension...that will leave you in Canada without status. Do the medical exam for the visa. If it isn't sufficient, IRCC will request you go fo another one for the PR application.

So I don't have Implied Status for applying for Inland Sponsored by Spouse PR + Open Work Permit ? I was really under the impression it would give me that status until the process was done, just like the Visa Extension one.

Your problem sounds like common Russian problem.
I'm not sure what that had to do with the OPs deliema... but that said, my wife is Russian and didn't have any issues at all getting docs...

It is common amongst any country..

Applying for an OWP with an inland PR app does maintain your status.

Did you submit the PR/OWP app BEFORE your visitor status expired? If you did, and if you are sure that you submitted a complete PR/OWP app and it won't be returned, then you can withdraw the visitor extension app.

Otherwise, just do the medical for the visitor app. You can use the same medical for the PR app.

I did submit the PR/OWP before the visitor status expired, my birth certificate finally arrived a week after submitting my extension application as well.

I suppose I will do the medical then, if they use these exams for the other application, I assume having that done now will save future time in the PR/OWP process.

Thank you for your advice!

Update- Just noticed on my CIC account that my extension request was "approved" and case status "closed", even before doing the medical (got the form yesterday) so I assume I got approved under the condition of still doing the exams.

Yes, the visitor record will state that the medical must still be done for the approval to remain valid, generally within 30 days.
