If you qualify as 'Common law partner ' as specified by CIC, you and your child also can accompany your partner , or follow afterwards. If required you can apply for work permit and your child can attend school, as per the existing regulations.

For more details read carefully the Guide 5487 - Applying for a Work Permit outside Canada at the CIC website here :

thank you..i have a question again...what if my partner married twice the first one is 1995 and the 2nd one is 2004. if he declares me as spouse in his original application then if we arrive in canada and filing for permanent resident or provincial nominee and the first marriage is annuled AFTER our marriage...would it be possible our application be refuse? coz we have a daughter and he has a son on his first marriage...the marriage indicated on the birth certificate of the 2 child was different...will it affect also on our application? even if the first marriage is already annulled or it would be easier if we apply as common law.. thank you for your great help.....

Yes, because he was already married when he married you. So your marriage is not legal.

Yes, he must provide all the evidence to support your common-law relationship. If he does not declare you in his application, you are barred from being sponsored for permanent residency in the future in the family class.
