Help Please..... Employer copied all the duties from NOC website

Hi,
I have applied for Canadian immigration under CEC in Jan 2013. I received my AOR Mar 2013. In my job reference letter employer just copied all the duties from NOC website. What should I do to void any problem due to this?

Maun,

Your application is into rough waters for sure. We have had couple of instances reported in this forum. The ones who tried copying the exact duties from NOC, have their applications rejected without any room for explanation.

The only thing that you do can do now. Get a new Reference letter from your employer with duties and responsibilities listed in your (employer's) own words in line with your NOC code. Submit to CIC quoting your AOR and request them to discard/ ignore the earlier letter submitted and consider the new one.

You can just bank on your luck.

I am working on close work permit and my work permit clearly says the job title. r they not going to consider that? do they just go with Employer letter?

Your employment letter is very crucial to assess the work you have performed.
Your work permit gives your job title but you will have to prove that you performed the qualifying job.

No one really knows. They may consider it, but I imagine, like Andy, that it will look suspect.

There would be no issues if the duties match, but if your employer has copied word for word all the duties listed under the NOC, I think it could pose a problem!

It likely depends on so many things: -

1) What duties were outlined with your job offer. If they match, this would help verify that you have done what your employer is saying.
2) Have you actually completed the outlined duties?
3) Have they used the same NOC on your work permit?

Seriously, some employers are just lazy to say the least. Don't they have the main duties expected of the employee when posting the job advertisement? Yet can't be bothered to do that for an employment letter? Ridiculous!

@Maun, like Andy said, ask your employer to issue another letter but this time in their own words. Is there a reason they copied it word for word from the NOC? If so, they could include an explanation(doubt they will agree to but you can ask). Submit it and hope for the best.

For other applicants - read your employment letter, verify the information and cross-reference with the NOC before submitting the application.

Thanks Guys,

The duties of my job letter (copied one) are same to the duties mentioned in my job offer letter. The Employer said job duties mentioned in NOC are what I am actually doing. That is why he joust copied an past it.

Now he is willing to issue me a new Job letter in his words.

Actually through this forum i found that Job duties should match the NOC ones. In order to make sure i Just compared my job letter duties to the NOC Juties and found that he just copied from there.
Is it OK to send them an up dated letter or do i need to give explanation about whole thing to CIC?

Job duties on the letter are same as mentioned on Job offer letter and I am actually doing all the duties.

A better way to put it is, find an NOC code that is "most consistent" with what your main duties. This way there is no confusion about "matching" duties to the NOC which to some employers may mean "word-for-word". For example:

NOC code says, "provide customer service"

Your employment letter says, "answers calls from clients, provides general information, directs calls to appropriate personnel, etc".

What is described in the letter is consistent with customer service and but does not copy what's in the NOC code it word-for-word.

90% of times LMO is refused due to poor presentation. so work on your paper work well before submission
browse google for sample lmo/noc docs etc. and research on using equally matching words (s.c to lmo)
for example : if s.c or work.gc.ca under specific noc states - supervise - (you got to have something equally good with brief explanation)
eg: monitor work relating to escalations, customer satisfaction and adhere to stipulated guidelines

Generally, it is true that they should not be identical to the NOC, it is - at best - an indicator of a "lazy" description (and therefore probably not 100% accurate), and at worst, deliberate fraud. There used to be somewhere in the instructions a statement not to do that, but I can't find it now. Possibly, a lot of employers are genuinely lazy :)

If those were the same duties submitted for the LMO and on your work contract (and according to you), those are the actual duties you perform, then, those ARE your job duties.

If you are concerned that the duties will be rejected as "not authentic", then - rather than a new letter in your employer's own words, I would submit a copy of the job offer (showing the duties were the same in the job offer). If you can get a copy of the LMO application from your employer that shows same duties, then all the better. This should be accompanied by a written statement of why you are submitting them...

I have no idea about duties on LMO application but job duties on Offer Latter and Reference Letter are same. There is no difference between them (duties on both letters) and these are actual duties i am doing doing at work.

Now, he issued me a new letter with detailed responsibilities of my Job in his own words. after explaining him whole story i got it.
I sent new letter to CIC pilot- Ottawa yesterday with a cover letter requesting them to discard/ignore the older one and consider the new one, which is updated and has detailed duties of my job.

I hope it will be fine.
Any other advise from you guys in order to make it more secure?
