Help Please!! Applied since 2013 and still no progress!!!

Hi,

I appreciate any input from anyone with a similar case or generally has some knowledge about this situation...

My wife has applied for her citizenship in 2013. She received an RQ in March 2014 and submitted it with all the required documents in April 2014. Since then there has been no action whatsoever on her application. The only answer we get when calling CIC is that the application is still undergoing background checks.

Is there anything to be done in this case? What if the 36 months threshold passes? What can we do then?!

Apply for ATIP to understand the status of your wife's application status. It will provide various notes. Request for the one with the physical file notes as well.

Contact your MP. Let him know about the situation. If she has fulfilled her residency/legal/language requirements then she should not have any issue. You may have to directly go and meet your MP. If you do it over phone it may not be effective.

I know its terrible and helpless feeling, I had undergone that.

Here are things you may consider doing.

1) Approach your area MP, ask him / her to get some response from CIC, normally they get it in 2 weeks.
2) Get soon an ATIP report, which take about 31 days now.

In the meanwhile, weight your options whether to wait up to 4 years and get her case assigned to Citizenship Judge ?

As you know, the following are two main reasons for such delay, also called as Non-routine processing

a) If due to some reason, CIC think applicant has less than required number of days (In her case, I assume less than 1095 days)
b) If she had excessive overseas travel stamped on passport which was NOT clearly explained. CIC suspect, applicant living outside.

If you know or learn from ATIP report, that indeed she submitted application less than 1095 days due to oversight or mistake - Consider voluntarily withdrawing her application.

Re-apply once she is eligible under the new rules (ie when she gather 1460 (Plus 30 extra) days out of last 2190 days.

The reason being, if she has less than 1095 days, the CIC will drag her case for close to 4 years, then assigned it to Citizenship Judge.

In most of the cases, CJ deny the citizenship, you can hire attorney by paying over $1000 or more, its NOT worth and risky too.

I was given false hope that Citizenship Judge can consider my case as my immigration attorney had made calculation mistake.

However, CJ refused even to review my document and literally forced me to withdraw and re-apply

Basically - I wasted 4 years for no reason. Please think carefully and do the right thing, you know your situation best.

The 36 months is just a general guideline. So don't rely that is it something like mandatory deadline for them.
Like Canadiandesi2006 mentioned it could easily go beyond that time frame.

Thank you all for your feedback. I'll work on getting the ATIP report. As for contacting our MP, we did that however, the reply he came back after contacting CIC was not much different from what we have been hearing when we contacted them.

Well your best bet Will be ATIP report one you have it see where file is struck base upon that go to your Local MP and ask him to get clarification upon it , sometime officer forget to put the updates , once the test is completed they send physical file to the officer to check all detail one they are satisfied they change the status so look in to ATIP report what is missing and also try to remember your interview after test fi they raise any issue then look into it ,
