Hi all,

I am currently in a really tricky situation and would very much appreciate your advice here:

As you know, there are 2 qns "Have you ever been refused a visa...." in the application for EE. Since I was refused US visa sometimes ago (though I subsequently did get US visa), I have put "Yes" as my answer and provided the LOE.

However, as I am doing that, I'm worried that in my previous application for tourist visa to Canada 3 years ago, I had answered "No" to the question. I did get Canada visa at that time, but I'm very worried that the wrong answer in that application would cause me to be guilty of "misrepresentation". I was not sure what happened at that time that prompted such grave mistake, probably an oversight on my part, but I know the CIC would not accept that as a reason. Any expert advice here on what I should do now?

We've put a lot into this application but now we really worry that it would be the end of it :( :( :(

Correct it now by answering yes, you wont be guilty of any misrepresentation.

Hi Anya654,

Thank you so much for your reply.

Yes we know we had to put "Yes" this time, but we are just wondering if putting "yes" alone would sufficient. Do I have to proactively state that I filled in the form wrongly in the past and provide explanation for that? I still can't think of a reasonable explanation for that error (it was an error/mistake which I regret, but I have pretty much forgotten it until now)

You don't really have to explain. CIC compares the 'locked' pre-ITA profile with the post-ITA profile only to check for any material differences which affect your program eligibility and/or CRS score. Since this change affects neither of those, you can simply change it in your post ITA profile and submit it without worrying about any chances of misrepresentation. Misrepresentation is usually any willful act of dishonesty which gives you an unfair and undue advantage over the other applicants and it clearly doesn't apply here.

If you're still worried, add a short note in the 'additional documents' section that you incorrectly answered this in your pre-ITA profile and have subsequently made corrections in the post ITA profile.

Hi Asivad Anac,

Thank you for your reply too. However it seems there was a misunderstanding here.

What I'm referring to is not pre vs. post ITA, but it's about the difference in this application (which I filled in correctly) vs. the application 3 years ago as a tourist (which I filled in wrongly for the question "Have you ever been refused a visa...."). Since I filled in correctly this time, do I have to proactively explain the reason for filling in the wrong application last time? And if CIC discover the mistake I made in my application 3 years ago, would that consider misrepresentation? That's my main concern

My bad.

No, that won't be considered misrepresentation while processing this application. That application is a thing of the past.

Hey Smm,

What happened in your case? Did you finally get an approval on your PR inspite of a mistake in your previous application.

I am in the same situation. I applied for a student visa and made a mistake in filling the form. It got approved. This was in 2014. Now I am applying for a PR and I am going to correct that mistake.

Can.i be accused of mispresentation in my previous application if the immigration officer compares the new and the old application

Please let me know as your experience will be immensely helpful in my experience.

Thanks
