Help on Lack detailed description on Schedule 3 page 2 Q.11

Hi All,

I applied Canada PR to Sydney CIO early last month, today I got a letter saying that my submission does not meet the requirements due to insufficient details in Schedule 3 page 2 Q.11. The letter said "No record of your application has been retained by this office. Should you choose to resubmit your application, please include this letter and the attached appendices with your application."

I plan to resubmit my application, however, I'd like get some senior opinions regarding my case before I re-apply.

I got my Ph.D (mechanical engineering) and worked in automotive industry as a CAE/FEA engineer for 5 years with H1b visa in USA, the job category for me to apply is mechanical engineer 2132, which is not on the 38 list. I wonder if I qualify the Canada PR under the new immigration law?

Also if I reapply, will this failed-submission affect my re-submission? I will provide a detailed description of my job duty, but do I need attach my resume and/or an employer letter to confirm that?

Hi Cathayee,

SO this means u applied for a NOC which was not present in the 38 list of occupations.

If my understanding is correct then you need to find out which NOC among those 38 list fits ur Occupation, you need to apply under one of those 38 list unless u r a student/temp foreign worker staying in canada for more than 1 year.

I would like to hear from other members as well.

That's exactly the point I warried. Mechanical engineer is not on the 38 list. But other occupations descriptions do not fit my job.

Can I write a letter to CIO officer and tell him/her that if he/she approve me, I will work in USA and live in Canada, paying Canada tax? ;-)

Any other opinions?

To my understanding , your qualification (mech engg) may not be the contraint here , Do you have a full time experience of 1 year in those 38 list /if somehow you can produce a experience letter of JOb/occupation mentioned in those 38 list of occupation whichever fits ur experience closely

If you could do above then u will be eligible.

The other part (work in USA/Paying tax in canada ) i am not sure on this :) , may be other members can suggest :)

The main thing here is whether you have experience in one of the 38 occupations listed in the ministerial instructions.The qualification is not an issue. You will just have to find which NOC (out of the 38 listed) closely matches your experience and re-apply again under that particular NOC.
