She is not giving you a divorce because she hopes to come to Canada with you. Once you decide to not to sponsor her, she will give up on you. Don't worry it will all work out :)

I feels you are lucky u got to know about her truth before filing the application so u can just file your application as non accompany spouse & u still have time to file the legally separated or divorce so later on if CIC ask you any proof u can give them.
But as if now i think you can apply for PR as non accompany spouse.I can understand your situation as i m in the similiar one but this forum gives me lots of knowledge what we hsve to do in our problems.
Personally i got the info which even my immigration consultant dont k oe abt it.So dont worry just go ahead & everyone is here to help us & guide us.

every one has suggested me to apply for PR as non-accompany spouse but when you said to file for legally separation how can i do on my own as she is not here in canada can i alone do it... from my end ... please advice.

also apart from any legal documents what do i include in my PR application.

please help.... seniors help out with my situation. how can i apply for PR excluding my spouse and stating as non accompany spouse with out a separation or divorce document....... please help.

Even i m in a process to removing my spouse that why i start this thread & i dont have any documents regarding legal separation but i have to as i already receive my medicals but not yet done.I have tlk to immigration consultnt & lawyers they told me first notify that my marriage is falling apart & make letter of declaration that i will not accompany my spouse & in future i canot dppnsor her even in fsmily class because she will not examined but notarized letter of declaration & affidavit will work as per what i get to know inthis forum & from immigration consultant.
You can also take some advice from immigration consultant as well.

can u suggest me what should write in the declaration and in the affidavit. also once ur done with your submission of your declaration and affidavit and done with your medicals and done with your visas kindly please keep me posted at all times so that i too get an idea...

Definately i will keep u updated abt my case but abt the format of declaration i got that from the gracy & veronica forum members post which you csn see on page 2 under this topic.My lawyer send the mail only to notify them once i get Reply will let you know & once i will send the declaration letter willlet u know.Do not worry bud u r not hiding anything from CIC. It will be fine which i hope & get confidence from other forum members advice.

She does not have to be here in Canada for you to file for divorce, she does not have to agree for you to file for divorce, the only requirement is that you are residing here legally (which you are doing if you have a work permit). You can apply for the divorce any time, even though it won't be final until you have been separated for at least a year.
