Hi,

I'm just curious if anyone can help, My wife is sponsoring me but we are a little lost with the process, we're pretty much nearly completely done our spousal application for Canada and all the work it comes with, but I'm curious we live in quebec, do we have to apply for a csq / undertaking after we get the first stage done by cic. It's not very clear to me, I've read other people haven't applied for a csq but on the generic application for Canada (imm0008) it asks yes or no and if you say no it asks when you have applied.

any help would be great, we're getting stressed out.

regards

Pat

You will apply for CSQ after approval from CIC

leave the column blank on IMM008

I am not JMOBhatti, but I had a similar situation and therefore I can tell you full of confidence, yes, you can!
I did it the same way and I received my new OWP within 10 weeks of sending my PR + OWP applications.

Well I have no CAQ/CSQ yet so I could not include that with it. I had an OWP before this pilot OWP, but it was issued under the IEC program. There are mixed opinions about working under implied status on this particular work permit. Since I did not want to take any risk, I stopped working and had implied status for only 12 days, then I got my new OWP. Since I have a permanent job here already, I just took those 12 days as holidays and continued working with the new permit.

However my new work permit says: temporary resident status maintained per R183(6) (which mean visitor, not worker)
So I am quite certain I was not allowed to work once the first permit expired (because it was a non-extendable work permit to begin with).

When you have a normal extendable OWP, then you would be allowed to continue working. It would give another condition like R###(#) on the new permit, that will mean you could continue working while on implied status.

sounds interesting Danny, I was sponsored by my employer to stay for two years and i have a work permit which is expiring june 30th, I've filled in the application to change work conditions or extend my stay in Canada and put OPW in the drop down box and have left out the csq section which i also don't have. I've also left out the lmia section. this will be ok to send in ? also i see your in quebec also anything else I should know ?

Basically if your work permit was extendable by nature (that means: not issued under a program that has a time limit on the work permits, like IEC which is only valid for 1 or 2 years and cannot be extended) you are on implied status as a worker and can continue working (if the OWP + PR application was received by CIC before your current permit expired) until a decision is made on the new OWP. You would have to meet the conditions on your old work permit though. Since I guess that your permit was restricted to one employer, you can only keep working for that same employer.

No need to add an LMIA since the permit has no requirements but to be sponsored by your spouse. Also no CSQ, you can leave it blank, CIC will request this from your sponsor once the CIC requirements are met to sponsor you. And for intended work section, write either N/A, not applicable or leave it blank. I believe I left it blank on my app.

Thank you for the help danny, i don;t mind working for the same employer if thats how they think it should go.
Just one more question, what box do i thick to show i am applying for one or more of the following.

* A work permit with the same employer * An initial work permit or a work permit with a new employer
* Restoration of your status as a worker * Temporary Resident Permit

What type of WP do you currently hold? Is it an IEC or PGWP?

If it is, you may not be able to continue working, as mentioned in your other thread.

As your current work permit is a closed permit issued on the basis of an LMO, you are required to work for the same employer while you are on Implied Status. Once you receive your OWP, you can change employers.

Select "An initial work permit or a work permit with a new employer".

It is a closed permit, thank you for the tips. also it says the stamped receipt on the checklist for the " change work conditions or extend my stay in Canada " permit, but I will be paying them online will i submit that receipt when I pay, and click the box on the document check list.

They will email you a receipt when you pay; I believe you can just upload a copy with your app. Make sure to pay both the $155 work permit fee and the $100 OWP fee.
