If you are close to an extention or have an extention in process ... my conjecture is it should not
matter... as long as you can submit extention receipt/paystubs etc as proof that the extention is in
process it should be fine... what really matters is that applicant is legally in the US on a work permit
and secondly that he has worked in US for more than a year at the time of applying for nomination...

I am not accurately sure but some where I have read that AINP recommends to start CIC process in
Buffalo.. I believe they might be asking to do that because they send the nomination certificate to
Buffalo office... but if the candidate moves out of the US and informs CIC with his new address .. it
is upto the discretion of CIC to move application to that country ...

alberta hotline can clarify this... somebody asked similar question at the seminar

Hi Redstar,

I am a Newbie and have been looking over old posts and it looks like that I have similar case like you except that I am about to start the AINP process and was thinking of hiring the same lawyer as you did.

I am working on H1-B since Oct 2006 and my visa is expiring in Oct 2009. I will be applying for H1 –B extension or may be H1 transfer in July.

I am concerned if this will affect my AINP application. Was lawyer at all helpful in providing guidance regarding this issue? What all documents he asked you to send for this.

Anybody with H1-B extension deadline and applying for AINP process!!!!!!!!!

Please please help
I think just some one in this group only given answer to this question.
Thanks & Regards
