Good day everyone! I just need your help regarding my present situation... I am working as a restaurant supervisor and I have a common-law partner here in Canada who is willing to sponsor me and my dependent child in the Philippines... We will turn one year this coming August and we are planning to apply for sponsorship for my permanent residency... But the problem is... I am still married in the Philippines although we are already separated but not legally. The question is will it affect my application for permanent residency? Do I need to process an annulment first? And for my son... Do I need to file for a full custody for him so we can include him on the application?

I really need your help and I am looking forward for hearing from you soon... I just really want my son to be here in Canada soon and to live with me and my common-law partner. Thank you so much and God bless!

You can not apply for permanent residence right now...
you need to be divorced in order to do that....
I understand that annulment is very expensive and takes time....
and you need to get a good lawyer in Philippines... but is not easy...

You are in Canada now,
therefore you can get your divorce here.... I believe that it will be easier in that way...
but you need to have full custody of your children in order to have them in Canada....

You can consult a lawyer here in Canada and he will advise you about the best way to do that....

You may need your husband to write a document in which he grants you full custody of your children...
and would be important if it get authenticated by the Canadian Consulate in Makati...

Good luck....

1. No, you don't need to be divorced to apply as a common/law spouse.
2. You need proof of custody and the ability to remove the child from the Philippines. It should be a court order.
