HELP! I sponsored my common law wife has left me, what am I in for?

Heres the detail?

We broke up 2 weeks ago, she moved out last weekend. We are unable to reconcile the relationship. She hasn't "landed" yet, but got her work permit 2 months ago. She got a good job, but just got fired on thursday. I just found out she's sent an application for EI benefits.

We still havent recieved the letter to go have the interview, nor has she landed and we haven't paid the landing fee

Am I going to be on the hook for this? For her EI premiums?

Can I still withdraw the application if I choose to do so?
 
You may withdraw an application anytime before the applicant lands.

I'm pretty sure you wouldn't be on the hook for EI -- it's insurance that her and her employer have already paid the premium for. It's not considered social assistance, AFAIK.

Are you ABSOLUTELY certain that the relationship is unreconcilable? If it is just a "time out" then you may be better off leaving well-enough alone...
 
I'm pretty sure that our relationship cant be fixed. I have no intentions of being with her anymore, and she feel the same i'm sure.
 
Also, I wonder.... If I withdraw the application? Does it affect here status or her work permit? I don't really want to screw her over.

your going to "withdraw" your application weeks before landing, and you "don't really want to screw her over", your kidding right?
 
Well, she has a decent job, and If she'll lose that then I wont withdraw it. She dumped me man.
 
And, I dont want her screwing me over. I worried that i'm on the hook for her.

You need to evaluate the situation before you decide what are you going to do.

1. You have the right to withdraw the sponsorship up to her landing anytime. If you withdraw she will loose her open work permit and her job as well as the her current status in Canada. If she wants to stay in the country she has to do it on her own- like getting a tourist visa or work permit. If she wants to become a permanent resident she has to apply in FSW or other categories, but she may not be eligible for any of them, so this sponsorship might be her only chance to get PR.
2. If you decide to proceed with the application considering that her landing is very soon, you are misrepresenting yourself as the common-law union is the ground of the sponsorship and the two of you are not together anymore. You are signing the undertaking for 3 years from the date of her landing which means that you have to pay the government back if she applies for any social assistance during this time. Note that EI is not welfare, it is an insurance deducted from someone`s paychecks. She is probably not even eligible to collect EI benefits, because she needs certain hours accumulated and I guess she worked only 2 months.

For what it's worth bbrjb, I think you are doing the right thing, unless you have kids with her.

Yes, she will. She only received the WP as part of the inland spousal application. She will also lose her status in Canada. BUT you DO have to take care of yourself in this. Maybe she is eligible to apply as an ecomonic immigrant if she really wants to live in Canada and meets the requirements.

Agreed. If no children are involved, cut your losses. It's not worth the risks.
