@ Leon and others,

Can you tell me if out of status time is counted as time in Canada before PR? I'm assuming not, but thought I'd check.

I had a 1 year work permit, for which an extention was refused 3 weeks before I applied for PR, so I was out of status during the PR application process. I now have PR, and would like to know if the time I spent out of status whilst waiting for PR can be counted, or if just the 1 year work permit is counted.

Thanks

Looking at http://www.cic.gc.ca/english/resources/manuals/cp/cp05-eng.pdf I can see no reference to out of status time. Only that time spent in prison or on probation or parole does not count.

Leon thanks for the manual - interesting reading.

One other question regarding residency requirements (for citizenship or renewing PR)...when declaring your absences from Canada, how do they know if you were gone for 1 day or 1 week or even a month, since Canada does not do exit checks when you leave?

They do work with some other countries, for example the US but I do not know if they have instant information to that or if they must request it. There are also the customs forms you hand in every time you enter Canada by plane. On there, you fill out how many days you were outside Canada. I do not know if they keep those forms or use the dates from them.

Many people seem to have gotten away with lying about their days in Canada and others have said that they were called in for interviews and the immigration officer had an accurate list on the table with all their entries and exits on it.

They are cracking down on citizenship fraud now. If you lie about your dates, you take the risk that they will catch you. It is better for you to wait your turn and be confident that you never have to look over your shoulder because you gained your citizenship legally.

Citizenship gained by lies can be revoked again if they find out, even if it is not until later.

I'm not suggesting, or condoning, that anyone should lie to get citizenship or any status. However I am sure that people out there have done.

Good to see that they are taking fraudulent cases seriously however.

Did they send you a letter and say they would call you for an interview? If they did, collect all your proof for the dates you were residing in Canada and wait for the interview. I have heard it can take a year sometimes.

You need 1095 days (36 months) in a 4 year period before you can apply. If you are gone for a month, you delay the date you can apply by a month.
