I am a Canadian Citizen, I am in the process of getting divorced and have met someone who is Jamaican. We are planning to get married in March in Jamaica. I have 2 kids, so the plan is for him to move here once we are married. Given that I am currently still married and we have not been together for a year, we can't apply for him to come here on PR card with the spousal sponsorship. Back at the end of May, we applied for him to get a multiple entry TRV so he could come visit me, meet my family and see where he is going to live. In the meantime, he applied to come to school in my hometown, which he was accepted, but because the CIC in Jamaica is behind in their processing, we had to defer that to another semester as we couldn't apply for the student visa in time for him to start school. So, we are still waiting on a decision about the TRV. Hoping to hear this week. I have tried calling immigration, but all they could do was email me exactly what is on their website....which isn't particularly clear to begin with! I really want him to be able to come and spend a significant amount of time with me here before we get married.

My questions are:

1. If his TRV is approved, how long will he be able to stay in Canada?
2. When he gets here, can we apply for him to get a work visa if he is offered a job?
3. We are marrying in JA, is he going to be able to come back to CA with me on the TRV after the wedding and stay until his PR application is processed?
4. What is the best process for applying for his PR card? in JA before we leave to come back after the wedding or in CA?

1. Six months. Once in Canada he can apply for an extension (no guarantee it will be approved).
2. If he is offered a job, the employer will also have to obtain an approved labour market opinion (LMO). As part of this process the employer will have to prove the job was advertised and no suitable Canadian could be found to take the role. If the LMO is approved (not all are), your partner can then apply for a work permit.
3. If he has an approved TRV then he can certainly come to Canada. How long he can stay in Canada will depend on how long the application processing takes and if he is granted extensions to his visit. Long story short, no guarantee he will be able to come with you and stay until the application is finalized. But you can certainly try.
4. Generally the sooner you can file the application and get the process started, the better.

Thanks for your help syclla. He is younger than I am and so doesn't have a huge amount of savings and owns no property, I am a bit concerned that his TRV will be declined. I did send an invitation letter stating that I will be paying his expenses while here and send documentation in his application of how much I make and how much I have in my bank accounts to support him while he is here, but I don't know if that is going to be enough. Do you know if there is any other options we have for him to be able to come stay with me? It is really important that he be able to meet my kids and them to get to know him before we get married!

If the TRV is refused - he could try to come on a study visa. However he'll still have to prove that he has strong ties to his home country and no plans to remain in Canada long term. So if he's refused for the TRV the study visa is likely to be a problem as well. Also, to be approved for a study visa, he'll have to show a bank balance covering first year tuition (as a foreigner he'll pay significantly more than a domestic student) + $10K living expenses + travel expenses.

I supposed another option would be a work visa. But it's quite difficult to find employers will to go through the LMO process.

If the TRV is refused, I supposed you and your children could visit him instead.

thanks...the kids are only 4 and 5 and have trouble with the ex giving me permission to leave the country with them. It seems that no matter what we do, someone is telling us no! Oh well, guess that is sort of what I signed up for!

Don't be frustrated this is just the start of your long journey to be with your love one, a lot of people in this site has the same situation as yours.
