HELP Complicated urgent Problem, Please help! I'm so frustrated!

Hello everyone,
I have a very complicated problem I need your help and opinion on. I have been working as an engineer since November 22, 2010 in a company. I got paid around $20 an hour until May of 2011 when my company ran into financial problems, my pay got reduced to $15 an hour, until this day.

However, when I had to renew my working permit they required me to get an LMO (Labour Market Opinon). I didn’t need this for my first working permit, reason is that I applied as a youth mobility class (working student) because at that time I was a student, and by the time they issued my working permit I had already graduated and started working as an engineer.

In order to get an approval, the labour market opinion required me to get paid $30. My company and I agreed that in ordered for me to stay working here, we would tell the government that I got paid that amount ($30). So here’s the problem, technically I have over 2 years of working experience, but I don’t get paid how it says on my labour market opinion (30 dollars), I get paid 20 which I agreed on. Will the CIC officers make a big deal out of this? Is there anything I can add into my application to get my papers approved, because I have all the requirements, it’s just the pay issue? How should I deal with this?

Any inputs on just telling them that I worked for $30 as a part timer for over 2 years, because apparently they also allow part time jobs as long as they can cover the full time experience.
My thought was either tell them the truth, but that would mean I would screw my boss over who helped me to stay in the country or I tell them I’ve been working for 2 years part time/flexible time. But then what about the pay stubs if they require them. Any thoughts or ideas???

You agreed to it - so you are just as in the wrong as your boss. The lucky thing for you is that CEC isn't really based on wage/salary, however they can look at it if they think it's excessively low, as we have heard from other applicants.

Complete the CEC application, provide everything that is required and hope that it works out well.

The worst option would be to misrepresent or lie on your application, which is what you're suggesting. Does your WP have your wage listed? If it doesn't, then your misrepresentation on your LMO may not come in the radar.

However if you either misrepresent your application, or they note that you misrepresented your LMO, your work experience could be considered unauthorized due to your prior actions (i.e. your work permit was issued under false pretences).

I was on the same boat as you . I am getting 20k less than what i mentioned on LMO. The thing is there are lot of work arounds and they ll only make it an issue or would even notice it if you really have a bad luck . You do not have to submit a copy of LMO with your CEC application so they wont know what your LMO says . Also CIC and Service Canada are 2 different entities . They may have access to your info but chances are higly unlikely that they ll create any issues. Just go ahead and apply according to your last T4.

I am not trying to say what we did is right but under certain circumstances you are not left with choices. All The Best

hi I think your wages only consider when u apply for lmo and for cec class visa officer consider about your job duties and your working hours and continuous working conditions visa officer only ask u about wages if u r getting pay lowest than your job degnation
if u r it And u getting $10.25

first of all, thanks for all the inputs guys, that really helped me a lot. However the working permit does not say any wages. It only says what your occupation is and where you are allowed to work (which is only my current company). Unfortunately on my LMO it says how much I should get paid hourly. But like sabidhawan already mentioned in the previous comment, sometimes you are left with no choices.

I thought about it though and found out I could say I worked part time or flextime, which I really do. And the 2+ years might come handy at this point. Don't you think? Because I could keep my wages at 30.25 dollars/hour and still get my work experience together. The only thing is I don't have my T4 for 2012 YET. What do you guys think? Thanks for the comments already :)

Well ya, I do realize that. Thanks!! I thought I am talking in a forum and not with a Visa officer. Don't we all have the same goal or am I off topic now with this forum. Because if I want to be by the book, I might as well call this number 18882422100. No?

Just go ahead and apply with your current job pay . I would say it is misrepresentation if you are getting 40 k and you write 60 k . Your LMO has nothing to do with your CEC application and both are handled differently.

I think you are right, I won't mention the hourly pay. I'm just going to write an estimate of my annual salary ( I mean they can see on my T4 anyways) and then if they ask anything about the pay then I will take the 2 years as my last resort. Thanks for your help though sabidhawan :)

What is misrepresentation is telling them you worked part time when you worked full time.

This can easily come back and bite you in the ass, the choice is yours.

If you are sensible you will apply with a ref letter stating the correct hours per week. Chances are you will be fine doing this. If you blatantly lie, on your head be it.

Anyone suggesting you should lie isn't the kind of person you want to take advice from under these circumstances.

People's abuse of the system makes everyone suffer - the CIC gets more and more distrustful, and everyone else suffers with more rules and more stringent interpretations.

It won't be hard for CEC to figure out what you get and if you have lied. They'll have your T4 in your application.

You definitely aren't a victim, you signed up for it. You plotted with your employer to fraudantly get a visa and now intend to lie and misrepresent yourself to cic.

Don't come here looking for support or sympathy dude - you won't get it.
