i have read some inputs from topics similar to my situation, and so far from what i have gathered are positive inputs, like, it doens't really matter to CIC if my wife is out-of-status here in the US as long as she was admitted legally and the other input like, you don't need to prove financial capabilities if you are sponsoring a spouse. Which makes me feel really better, atleast a little bit.
here's my situation;
i was granted canadian citizenship 15 yrs ago but since then i have been working here in the US for a company who tried to sponsor me for a working Visa. Fortunately for them they have become HUGE but unfortunately for me because of that reason they have to let me go.
it would have been alright, but 2 yrs ago i met my wife of over a year now and we have a son who just turned 1, and the problem arise. Since my only option is to go back to Canada i need to move my family over there and start over, unfortunately the situation is a little bit more complicated since my wife is currently OUT-OF-STATUS here in the USA. She came here over 4yrs ago with a 1 year exhange VISA and never left the country ever since then which was fortunate for me
Family members are telling us everything would be ok, but my wife is very skeptical.
the plan right now is for me to go back to canada with my son and start the process of sponsoring my wife inside Canada with my wife still here in the US. She is trying to accept the solution but i know deep inside she's hurting since she will be AWAY from our SON and we don't know if she will get approved a PR visa and how long will the process take. right now we don't have anything but 5k in savings and i will be looking for a job when i get back but not sure when i will get employed.
so here are my questions;
1. - would it matter where we file our application? inside CAnada or in US (would it be a problem for her since she is out-of-status)?
or would she be asked to go back home to her home country?
2. - with regards to financial issue, would i need to wait to have a job before i could sponsor her?
3. - with regards to Police clearance, does she need to go back home at the beginning of the process to get the clerance from her home country or can she get her police clearance from US? I am confused on this matter. from which country does she needs to get Police Clearance, from home country or from current country of residence?
4. - is there a way to speed up the process for my wife to be with our Son?
i would really appreciate any input from anyone!!!
