Dear all

I am in big trouble. I am questioned by visa officer for misrepresentation.

My noc code is 0631 and now in great danger.

The evidences VO declared in hand were obtained from a site visit. However, these evidences are totally wrong by nature. The VO said I am not a management level person, but in truth I am, I have mounts of working documents to verify my management experience, VO also said I have duties of ABCD but I never done these things before.

VO claimed to have spoke to HR to verified my duties as 1234...but HR denied he had ever told them like that and willing to offer me written statement for my arguement. VO even said I confirmed my duties as 1234, but during that site visit I spoke nothing about duties. The evidences VO claimed should be questioned greatly!

The officer is now giving me an opportunity to explain. I wonder if it's manner to show their fairness in procedure, even if I submit solid evidences they also can refuse me for misrepresentation? Or if I submit solid evidences to support my claim they will lift this concern?

Is there anyone who has the similar experience before but finally success? I need help, advice and experience sharing of every kind!!

Sorry to hear this. Couple of questions:

1) Reading your past history it seems you had no proof of taxes, etc given that you where paid in cash, what types of proof in addition to the letters did you submit?
2) Did they do a site visit?
3) What country do you live, did you work on the same country?
3) What is your VO?

I am just trying to get more insight to comment.

My Assumptions:
1. Ur IO had a visit of ur working location;
2. U were present & were spoken with;
3. Ur Manager-HR was present & was also spoken with;
4. The IO might have observed u working;
5. The IO might have assessed the complete working atmosphere;
6. S/he might also have spoken with others.

My Opinion:
1. Probably ur IO noticed an/y anomaly in the entire work processes;
2. Probably s/he also found distorted responses between u & ur Manager-HR;
3. Probably s/he didn't notice/observe u in a decision making role [in ur org];
4. Probably there was something 'lost in translation', or a misconception;
5. Probably, his/her perception of the 'works' was conjured improperly;

My Take:
If u have serious grounds [with documentary evidences] to support ur claim, which is contrary to his/her opinion - u should & can contest it, and here's ur chance. Make a suave response, attach as much info/evidences that u can & humbly request him/her to reconsider. Explain ur duties once again. Attach that letter [which ur Manager-HR intends to issue u] and clarify ur IO's doubts.

End Note:
There's no harm in trying. Do ur best. U have the opportunity... make a good use of it.

Find out what exactly the HR person was asked and what responses were given. Prepare thoroughly. Goodluck!

Many thanks. Their comments on the letter were majorly not stated by HR on that day, which HR can issue a statement for it.

I suppose they based on their observations on that day. However, they had only for max 10mins been with me and at that time I was talking to them not working on anything, I do not know what they could observe and lead to a conclusion, it is too subjective! too unfair for me
 
did you get IP in your e-cas before they did the site visit?
 
Ok my view.

No worries first. Calm down.

They may have visited you or may not. I have seen lot of people around getting claims by VO that they have checked a list of activities.

However in the end at the interview they cross check and you go ready to explain each situation.

Carry few documents to show your decision making process.
