This seems stupid probably but I reviewed my application after reading through some post. Moreso because I didn't remember one of the questions people were refering too. Anyways, to my horror, I did exactly what i had thought we did and answer no to the question on whether my spouse had ever applied for any type of visa. Our mistake was assuming that it was refugee claim, PR and didn't read the entire thing and see the little word visitor visa. He did in fact apply for and got rejected for a visitor visa back in August, prior to us getting married. This is due to not proving he had substantial ties to bring him back to his own country.

My question is what is the best way to correct this, it was an honest mistake. I am sure that other people have made it. Stupid, one of those things they always say to do, read everything before answering. :) Currently, I am waiting for the application to begin processing for step 1, so I don't have any number to refer to if I need to contact them.

Thanks for any advice someone can share.

I don't have any advice, unfortunately. Did you mention the visitor visa request and denial elsewhere in your application? I would think if you did, it would be clear that your intentions were not to try to hide anything. After you get sponsorship approved and have a file number, then you will have the information that will facilitate getting additional information into your file, if you decide to contact your visa office.

Thanks QC, we didn't mention the application at all. I just didn't think about it, as it was refused for a typical reason. So honestly it didn't even cross my mind one bit. And like I said, I answered the check boxes so quickly that it slipped through, otherwise yeah I would have said yes and just written a comment. Anyways, thanks for your answer. I appreciate it. I will call them and fax them something to clear it up as soon as it starts being processed.

Hi nylalisa,
I made a mistake on my application also, and when I figured it out, I called the call centre, and talked to an agent who advised me to write them a letter attached with a cover letter and my client id (she said I didn't have to fill out an application). I would suggest you do the same. Hope this helps. :)

Hey Quick Question,

Did you guys wait until your application was in process to send the fax?

I'm concerened that if we wait until it's in process they will send the entire application back to us. I would rather take pre-emtive action and send them the missing document first. However i'm not sure how they will associate it with our application until we get a client ID.

What did you guys do?

seems like im not alone here,,lots of people had mistake in answering the background declaration, my case was i was refused toofor tourist visa back in 2007 when im still single,my family lives in canada and 2010when i applied and im in in common law already , i only gave the details of the recent refusal , i already forgot the 1st one cos its long time ago, should i call and send letter too?any advice ?this is driving me nuts :'(...my mistake is i ddint photocopy the docs i sent them ..

I sent it online with my information (client ID and kit #), after I knew it had been transferred. At first, they told me they didnt have the file open yet and to wait until they contacted my husband. But then I asked them (by email, if waiting that long was gonna cause them to process it without the proper info). I didnt want to be accused of misrepresentation. I was as polite as possible to :). They sent me back another e-mail telling me my file number and acknowledging it had been added. So long story short I would wait a minimum of 10 days from the day you get approved at CPC-M, then if u want to correct it early put as much info as you have: sponsor's name, applicant name, your sponsor's id number and kit # ...

tnx so much, its driving nuts, should i just tell that i forgot to add the other details since its long time ago?i cnt even remember the date of application for my first refusal, should i send it through manila office email? we just sent last jan 9 at missusaga. did the call center told u that this is no big deal or it will cause trouble if we wont correct it?

Its not a problem with regards to the first stage approval in Canada. They purely look at the eligibility to sponsor here. It is with Manila, you will correct it. If you just sent it on the 9th, it will take just over a month for first stage approval (rough estimate based on the time it took for december applicants). Check ur Ecas then abt 2 weeks after approval contact Manila, I sent in just the new form with the corrected info. And told them what happend. The main thing is that u say there was the visa attempt, put approximate date abd just tell them ur unsure of the exact date.

Send an email and also send a letter, just to be safe. You don't need the exact dates of the first visa and refusal - they will be able to find it. You just don't want to be accused of misrepresentation.

As for the question about your sponsor's citizenship, the visa officer will see from the forms that the answer should have been 'no', so don't worry about that one.

I would personally wait until sponsorship approval and then contact Manila with the information about your file. Missisauga is in no way concerned with that form, when I realized the same mistake, my file was still at CPC-M. They told me to correct it with the visa office in charge when my file got there. Again, this is what I did, some other posters may have done it differently and can offer their opinion.

This letter is to correct my unintentional mistake regarding the Application Form- Schedule 1 Background / Declaration, on no. 9. Have you, or, If you are the principal applicant, any of your family members listed in the application for permanent residence in Canada ever:
Previously sought refugee status in Canada or applied for a Canadian Immigrant or permanent Resident visa or visitor or temporary resident visa?
Im not sure if I answer Yes or No, or if i accidentally overlooked it since i thought it about the refugee status question alone, To make sure I answer it right thats why im writing this letter,
The answer should be check on YES

Another concern is I answer YES on the next question .Been refuse refugee status in or an immigrant or permanent resident visa, or visitor or temporary resident visa to, Canada or any other country, or have been refused a Certificate de selection du Quebec (CSQ) to Quebec?
My answer is YES , But I wasn’t able to provide the other details , I was refuse last Aug 2010 cause me and my partner was suppose to visit and I was refuse which i explain, but I forgot to add the details that I was refuse also before, approximately yr 2007 (cant remember the exact date and other details).
Once this cross into my mind realizing I made unintentional mistake, I made step and somebody told me to write a letter once I got a file no. already. I am writing this letter so I can clear my mistakes, I have no intention of lying ,it was accident because were in a rush of completing the application so that my partner can bring it along with him in Canada last Dec 2010 when he left also being so bussy minded due to emotional stress of thinking of being away with Him and with us moving out of our apartment.
Along with this letter I am sending a corrected Schedule 1 Background / Declaration

This is what I wrote...

Request: Re : Correction of IMM008 Sponsor's # XXXX-XXXX, Upon review of our application, an error was found on IMM0008, Schedule 1, Question 9 regarding whether or not the applicant had ever applied for a visa. This lead to the error of whether the applicant had been refused for a visa. Because the applicant and his sponsor read the question quickly, they misread the question and answered "NO" to both, when in fact the applicant had both requested a visa in the summer of 2010 and been refused for it around August 4th, 2010 (due to insufficient ties to his current country of residence). He had plan to come to Canada, to visit and meet the sponsor as friends and get to know her family and friends. After this, the plan would be to marry in India before family and friends at the end of the year. It was not the intent to misrepresent this situation and the applicant and sponsor apologize for this error and want to quickly correct it. It was advised by the CIC call centre that they submit this small explanation with the correction of this question on page 1 of the related form. Please find it as an attachment.
