WE WILL GREATLY APPRECIATE any advice or inputs we can get with my brother's situation in regards to his sponsorship for his family. Please bear with me on this... thanks a lot in advance.

in 2006 my parents, myself, my older brother & my younger brother was sponsored successfully by our eldest brother. Now my older brother who was sponsored together w/ us was unmarried at that time and was having problems w/ his girlfriend/partner but they have 2 children which is named after his girlfriend since they were not married yet. Thus the 2 children was not declared as his dependents at that time.
Then less than a year of being here they reunited and my brother found out that they are having a third child because the girl was pregnant when we left to go here. SO he decided to go back home and they got married. My brother experience some financial difficulties so only now he is starting to process the sponsorship for his family.
Our questions are
1. because only their youngest child is under my brother's name will he have problems sponsoring the their first 2 children because they are still carrying their mother's maiden last name as their surnames?
2. Can he sponsor them altogether at the same time under the family sponsorship or he can only sponsor his wife & the youngest child w/c is carrying his surname, and then after sometime his wife will be the one sponsoring their first 2 children?
3. What aere the complications, problems that may arise on this kind of situation?

I will assume that your question is in regards to him being able to sponsor the 2 children? If it is then I do not think there is any way for him to do so. It clearly states that on all the forms.

If it is not, then I would suggest being a little bit clearer.

If you're asking if he can sponsor his 2 children.....from what I've read....if not listed at the time of application or before his PR, then he could be unable to sponsor them in the future. However, I'm sure someone more informed will be better able to answer this question.
 
He should have declared his children on the original application. Doesn't matter if he was married or not.
He will not be able to sponsor them.
The mother might be able to immigrate to Canada on her on (as a worker, for example) and then the children could immigrate with her.

thanks a lot.. i edited my first post.. accidentally entered it right away halfway through typing.. do you think his wife can sponsor them once the wife is here?

thanks...yeah very big mistake at that time.. do you think he can sponsor just his wife & the third child.. & then the wife can sponsor the 2 children after?
 
Was he living with his girlfriend before he came to Canada, and if so, how long?

they live together even w/ the on/off relationship I think for 2-3 years before we got sponsored

yup after we came here... their relationship got stronger then he came back w/in the first year to marry her
 
The problem is that if he and his now wife were living together for a year or more before he was sponsored to Canada, he should have declared her and the children on his application. He would have been refused a PR visa in that case. Since he did not declare them, he cannot sponsor them now.
He may be able to sponsor the wife if he can show that they did not live together for a year before he 'landed' in Canada. You said it was an on/off relationship, so maybe.

He can definitely sponsor the youngest child.

ok sorry 1 more last question.. if he somehow successfully sponsor his wife, or in any other waythe wife gets here then the wife should have no problem getting the 2 children? thanks again
