Hi, my name is olufemi. I was concerned or let me say confused on this this question in SCHEDULE A BACKGROUND/ DECLARATION question (d) have you been refused refugee status, an immigrant or permanent residence visa or application to provincial nominee program or visitor or temporary resident visa, to canada or any other country?.. The question is I have applied for UK student visa and US visitor visa before that i was denied due to incomplete documents so, do i need to click yes and state the reason? Or NO?.. I live in canada and about to apply for my permanent reaidence through common law partner. Thank you
 
You need to select "yes" and explain the details of your two refusals.
 
There will only be a big impact to your application if you fail to mention these refusals. Failure to mention these refusals will result in a refusal of the PR application - and most likely a misrpresentation finding and a 5 year ban from Canada.

It is important to be honest with your application. From my sister's experience, she applied for work permit, initially denied because the immigration consultant failed to prepare or advise her to explain this to the CIC her previous visa refusal. Second time to apply, we did not use consultant anymore , but we just explained to CIC. Now she's here with working permit.

We maybe have different immigration permits, but I do think as long as you're telling the truth and your refusal was not based on security risk or criminal or other serious matter, no need to worry to much just explain well.

Your application will not be negatively impacted if you were denied visa earlier for simple reasons. Your application will be heavily negatively impacted if you lie and say No to this question. Say yes, and explain in a separate sheet of paper.
 
So if you were denied a simple work permit, which isnt an immigrant visa nor a TRV, you need to disclose that or face misrepresentation?

Whatever it is that the forms are asking you if you can say you have had the experience of what the question is asking then you need to respond accordingly. Once you apply for any form of visa you are issued a UCI number. Anything else you wish to do in terms of immigration is inputed in that file / linked to that UCI #. So lets say you were denied a visa to visit but you didn't disclose that on your PR application and the visa officer makes that finding, the first thing they will ask is why is your form is saying something different from your file. They'll need to assess why you're hiding that bit of info and they will then have to deduce if you were trying to fix the answers on the form to somehow try to cheat the system in order to get PR. Nothing is wrong if you were denied a visa. You more than likely just weren't prepared to the point that they require you to be. But omitting the fact that you were and writing no to a yes question is telling a lie and it's the lie bit that they take seriously. Now they have to find out what else you could be telling lies about.
 
Well it wasn't necessary a TRV, and i don't recall ever having a UCI, i was applying for a work permit renewal, not an entire work permit application(from US so im visa exempt and dont need a TRV ). I selected No on the schedule A when ask if you have ever been refused a TRV as I didnt think the work permit app was a TRV visa so im trying to see if this is misrepresentation, if so i will withdraw the app and start over....

No a work permit is different from a TRV so that's not misrepresentation.
