Hi.
I got pr card for 1 year.i have a hearing and the date is still not specfied.i have been in canada about 1 year.im.employed.i bought a car.My own busness about 200 thousand dollars will be opened next week.will this help me.and lets say if my hearing is negative.who will be responsible for paying back my busnesss and my home and my car and bank loans?thanks

How it goes will depend far more on the extent to which you were in breach of the PR Residency Obligation, assuming you were in breach, and whatever H&C reasons you document explaining why you did not return to Canada sooner. (If you claim you were not in breach, you will need to prove that.)

While you are establishing a business in Canada now, what is a bigger factor is the extent of Canadian ties (which would include owning or especially operating a business in Canada) you had during the period of time prior to the denial of your PR TD application, or prior to when you were issued a 44(1) Report (or whatever event it was underlying the appeal). A business now may have some influence but not much compared to most other factors.

This is a situation in which obtaining the assistance of a reliable, reputable immigration lawyer (not a consultant) would be a good idea. H&C cases are tough to make unless the grounds are compelling.

Agreed with dpenabill. Also, if the outcome of your hearing is negative, you are still responsible for paying back all your debts and other obligations.

Hi Dido, could you share how you enter Canada and get the 1 year PR. Is it via PRTD on H&C ground or through US border. Thank you.

You will. If you fail to pay your bills, your home will be seized and sold (if you have a mortgage), as will your car. Business loans are a little different - if the business owns property, it can likely be seized. If you personally co-signed, you are liable, and anything you own (or money in your accounts) can potentially be seized.

Even if there is no mortgage, your home can be seized and sold by the city hall in case you failed to pay your property taxes.
